REGULAR MEETING
ZONING BOARD OF ADJUSTMENT
JANUARY 18, 1984
The Zoning Board of Adjustment.of the City of West University Place, Texas
convened in regular session at the City Hall on Wednesday, January 18, 1984,
with the following members present: Chairperson Billings, presiding; members
Fougerat, Fromen and McKelvey. Mr. Wayne Perry was also present.
~- Chairperson Billings ascertained from the secretary that Notice of Public
Meeting had been posted in the City Hall on January 13, 1984; Notice of Public
Meeting was published in The Houston Chronicle on January 2, 1984; Notice to
~i Interested Property Owners were mailed on December 27, 1983.
Public Hearing was called to order to consider application 4684-1 from Mr. & Mrs.
Horst Paul to build garage into the five (5) feet rear setback on:
Lot 5
Block 2
Preston Place Addition
5821 Charlotte
was opened.
Mrs. Janice H. Paul stated that the old garage that was existing before the
construction of their new home, was three (3) feet from the back property
line, which is the same distance from the property line as their new garage.
After demolishing their old residence, they selected an architect that is a
resident of West University Place and he stated that he had built houses in
the city before. He also stated that he was familiar with the city's building
codes.
Mrs. Paul stated. that they were not informed over an eight (8) month period,
until one (1) week prior to the move-in date, of the problem existing, nor
was the builder notified of any problems with the new garage meeting the
building setback requirements.
Upon questioning, Mrs. Fougerat asked if .the builder's approved set of plans
indicated to locate the garage five (5) feet from the rear property line.
Mrs. Paul stated that her builder was not aware of the error, nor did his
plans indicate such problem.
If the variance is not granted, Mrs. Paul stated they would have to bear the
cost to reconstruct a new garage.

I disapprove of anything against the Zoning Ordinance of West University.
That is why we have the Zoning Board of Adjustment. I am in favor of them
being kept as is.
December 27, 1983
To Whom It May Concern:
The garage recently built at 5821 Charlotte has been constructed three (3)
feet from the rear property line. The approved plans were noted for the
garage to be located five (5) feet from the rear property line.
The builder. has assured this office that the approved plans were on the site.
It is apparent that the approved plans were not used to locate the garage slab
correctly. Also, the inspector apparently did not check the location.

Building Inspector
Building Inspector, Wayne Perry, stated the reason the permit was denied is
that the garage as built, would extend into the rear five (5) feet setback.
Mr. Perry indicated that Mr. Alford, the contractor, was given one (1) set
of plans marked approved with changes, .which were to be on the job site at
all times.
Upon discussion, it was pointed out that the sewer line could goasibly need
replacing in the future.
Chairperson Billings asked if the variance was granted under the condition
that the property owner would have to pay for the expense of removal to
replace the sewer line, would it be better to have the work done at present
or later? Mrs. Paul stated that it would be better to have the work done at
a later date.
No further questioning to the City.
Motion by Mrs. Feazel, seconded by Mrs. McKelvey, that application ~~84-1
from Mr. & Mrs:. Horst Paul to occupy a house and a recently built garage
th at extends into the five (5) feet rear setback on:
Lot 5
Block 2
Preston Place Addition
5821 Charlotte
be granted, with the condition that the property owner will agree in the
event that it is necessary for the laying of utility lines that the struc-
ture be moved, and that the removal be done at the expense of the property
owner, and that such restriction be made of record in the deed records of
Harris County, Texas.

Minutes of the regular meeting of the Zoning Board of Adjustment dated
November 16, 1983 were approved with changes.
With no further business to bring before the Board, upon motion duly made,
seconded and carried, the meeting adjourned at 8:15 p.m.
