ZONING BOARD OF ADJUSTMENT
AUGUST 24, 1983
The Zoning Board of Adjustment of the City of West University Place convened
in regular session at the City Hall on Wednesday, August 24, 1983; 7:30 p.m.,
with the following members present: Chairperson Billings, presiding;
Members Feazel, Fromen, McKelvey and Petronella. Building Inspector Mr. Wayne
Perry was also present.
Chairperson Billings introduced himself and gave his address. in the City,
followed by other members of the Board.
Chairperson Billings ascertained from the secretary that Notice of Meeting
had been posted in City Hall on August 22, 1983; Notice of Public Hearing
was published in the Houston Chronicle on August 2, 1983; Notice to Interested
Property Owners were mailed on August 2, 1983; administered oath to those in
audience desiring to speak_ during Public Hearing.
The secretary was asked to read Notice of Public Hearing as published.
Public Hearing to consider application X683-7, from Mr. William G. Mack to
construct a deck into the rear twenty (20 ft) yard to exceed 40% coverage on:
Lot 5
Block 33
Collegeview 4th Addition
4023 Swarthmore
was opened..
Mr. William G. Mack stated that because of the shade created by his home,
garage and neighbors treees, ground cover does not grow on 90% of his
backyard. And that since due to the fact that little can grow in the back-
yard, neither the adults nor his children can use and enjoy that part of
the property due to mud and dirt.
As an alternative to building the ground level deck, he stated that he had
considered cutting down his trees, and covering the backyard with gravel,
but the alternative would not be cost-effective, functional or attractive.
On questioning Mr. Mack, Chairperson Billings asked if problem existed before
his addition? Mr. Mack stated that the existing garage was demolished and
a new garage was added with a gameroom on the 2nd floor, and that the problem
did exist before the addition was added.
Mr. Mack was asked if the Board denied his request what other alternative would
he have? He stated he would build as much deck as could be built within the
20 ft. setback requirement, inwhich fourteen (14 ft) would be taken off of
proposed deck.
The following correspondence was read into the minutes in .favor of said
application.

Builing Inspector Wayne Perry stated the reason the permit was denied is
because of the existing coverage of the rear yard. The garage covers 40%
of rear yard.

`~~ Motion by Mrs. McKelvey, seconded by Mr. Fromen, that the Public Hearing
be closed.

The Board recessed for ten (10) minutes.
The meeting was called to order to consider application ~~83 7.
The Board members reviewed the appliiation with particular discussion concerning.
backyard coverage, of which not more than 40% may be covered by an accessory
structure. The existing garage is presently covering 40% of the rear twenty
(20ft) feet setback. Chairperson Billings stated that one of the problems
is that the garage was. built to an extent that it covers the maximum that could
be covered.
Motion by Mrs. McKelvey, seconded by Mr. Petronella, that application 4683-7 from
William G. Mack to construct a deck into the rear twenty (20ft) feet .yard to
exceed 40% coverage on:

Block: 33
Collegeview 4th. Addition

be denied, inasmuch as literal enforcement of the Ordinance would not cause
unnecessary hardship.

Minutes of the regular meetings of the Zoning Board of Adjustment dated June
15, 1983 and July 20, 1983 were approved as submitted.
With no further business to come before the Board, upon motion duly made,
seconded and carried, the meeting adjourned at 8:30 P.M.
