HomeMy WebLinkAbout06151983 ZBA MinutesX34 REGULAR MEETING ZONTNG BOARD OF ADJUSTMENT JUNE 15, 1983 The Zoning Board of Adjustment of the City of West University Place convened in regular session at the City Hall on Wednesday, June 15, 1983; 7:30 p.m., with the following members present: Chairperson Billings, presiding, Members Fougerat, McKelvey, Fromen and Feazel. Assistant Building Inspector Steve Ryan was also present. Chairperson Billings introduced himself and gave his address in the City, followed by other members of the Board. Chairperson Billings ascertained from the secretary that Notice of Meeting had been posted in City Hall on June 10, 1983; Notice of Public Hearing was published in The Houston Chronicle on June Ol, 1983; Notice to Interested Property Owners were mailed on May 31, 1983; administered oath to those in audience desiring to speak during Public Hearing. The secretary was asked to read Notice of Public Hearing as published. Public Hearing to consider application ~~83-5 from Roger B. Anderbert to remodel existing living area in a detached garage which extends four (4') ft. into the rear twenty (20') ft. on: Lot N i of 8 Block 33 West University Place 1st Addition 6509 Sewanee was opened. Dr. Anderberg stated that an existing living area in his detached garage contains a sitting room and bath which consists of a lavatory and .toilet. He is requesting to install a shower and small closet and move an existing outside door to another wall to accomplish this, and that there would be no added square footage; that all remodeling would be within the existing walls. On questioning, Dr. Anderbert stated his only alternative would be to move the existing building forward out of the rear twenty (20') fet., which was not physi- cally or financially practical. The following correspondence was read into the minutes in favor of said applica- tion: June 4, 1983 Zoning Board of Adjustment Please allow Dr. and Mrs. Anderberg to do the remodeling they request above, on appeal ~~83-5. I live at 6512 Sewanee, across the street from the Anderbergs and I heartedly approve of their remodeling plans. Anderbert. This family is a welcome addition to our neighborhood. ~' Mr. & Mrs. 0.0. Mitchell 6524 Sewanee Assistant Building Inspector Steve Ryan stated the reason the permit was denied is because the detached garage is four (4') ft. within the twenty (20') ft. set- back and this area would be used as temporary living quarters, and on questioning. stated there were no records on file in the Inspection Department as for the use of the building or how long the building existed; and that it appeared to have been constructed at the time the garage was constructed and not added later. Chairperson Billings asked Dr. Anderberg is he would be willing to execute an agreement that he would never rent this facility and have that filed of Records. Dr. Anderberg agreed. Motion by Mrs. McKelvey, seconded by Mrs. Fougerat, that Public Hearing be closed. Voting Aye: Billings Voting No: None Feazel Fromen McKelvey Board members reciewed the application with particular discussion concerning the fact that this appears to be an original structure and that the requested remodeling will be contained in the existing walls. Motion by Mrs. Fougerat, seconded by Mrs. Feazel that application 83-5 from Dr. Roger B. Anderbert for a four (4') ft. variance into the rear twenty (20') ft. on: Lot N12 of 8 Block 33 West University Place 1st Addition 6509 Sewanee be granted, inasmuch as there is no change of the existing use of the building or exterior structure, on the condition that an affadavit be executed by the property owner and filed of record, and that said restriction will run with the land, stating that the structure will not be rented separate from the main dwelling. Voting Aye: Billings Voting No: None Feazel Fougerat Fromen McKelvey 136 Minutes of the regular meeting of the Zoning Board of Adjustment dated May 18, 1983, were approved as corrected.
