HomeMy WebLinkAbout05181983 ZBA Minutes131 REGULAR MEETING ZONING BOARD OF ADJUSTMENT MAY 18, 1983 1 The Zoning Board of Adjustment of the City of West University Place convened in regular session at the ~~y Half on jYednesday, May 18,-1983, 7:30 p.m., with the following members present: Chairperson Billings, presiding Members Fougerat, Fromen, McKelvey, and Nichols. Building Inspector Mr. Perry was also present. Chairperson Billings introduced himself and gave his address in the City followed by other members of the Board. Chairperson Billings ascertained from the secretary that Notice of Meeting had been posted in the City Hall on May 13, 1983; Notice of Public Hearing published in The Houston Chronicle on May 5, 1983; Notice to Interested Property Owners mailed May 5, 1983; .administered oath to those in audience desiring to speak during Public Hearing; and asked the secretary to read Notice of Public Hearing as published. Motion by Mrs. McKelvey seconded by Mr. Fromen, that Public Hearing to consider application #83-4 from Steven Nance for interpretation of the Zoning Ordinance as it applies to: Lot 30, Block 17 Monticello Addition 2728 Plumb be opened. Voting Aye: Billings Voting No: None Fougerat Fromen McKelvey Nichols Mr. Nance stated that he and his wife because of growing family needed to expand the house they have owned for four (4) years from a two (2) bedroom, 12 bath to three (3) bedrooms and 2Z baths, but. that the lot is an irregular shape and. lacks proper definition of proper building lines. and that is what they are asking the -Board to specify. Mr. Consuelo, of the Design Consortium, presented a map showing the irregular design of the lot, which has two straight sides (north and east) with a curve area roughly making an irregular triangular shape with Wakeforest on the northern side and Plumb on the southern side. Also presented was a comparison of a rectangular lot (75'x150') in the neighborhood comparing lot coverage on a suggested proposal of subject lot (6170 vs 6370); a map of the neighborhood showing lots coverage of several properties; and two suggested proposals for development of the property. 132 Mr. Consuelo and Mr. Nance asked that the Board interpret the Zoning Ordinance and give them a definition of lot lines for this particular lot, i.e. rear, side, and front, so that they could design within the framework of the Zoning Ordinance. In discussion other points considered were coverage and location of rear yard with accessory building and locations of sewer line on eastern boundary and .location of two existing accessory buildings on east. (properties facing Charlotte) on the common property line. A conditional setback from 8 ft. - 10 ft, for any structure from the eastern property line was discussed with Mr. Nance. Copies of a map showing the property and suggested developments are on file with this application. Mr. Perry stated that this is a situation whre there is no definable back or front lot lines, therefore, he interpreted the back line to be on the east. Motion by Mrs. Fougerat, seconded by Mr. Fromen, that Public Hearing for con- sideration of application #83-4 be closed. Voting Aye: Billings Voting No: None Fougerat Fromen McKelvey Nichols The meeting recessed for ten minutes. Chairperson Billings entertained a motion on application #83-4 as follows: Motion that the Zoning Board of Adjustment interpret the Zoning Ordinance as it applies to: Lot 30; Block 17 Monticello Addition 2728 Plumb as follows: The Board defines the rear yard as that portion of the lot which is enclosed on the north by the northermost lot line and on the south by a line which is drawn beginning on the east property line to a point 20 ft. south of the north- east corner of the lot running parallel to the northermost boundary in a straight line intersecting the property line at 4Vakeforest; That the front yard line be defined as a line beginning 20 ft, north of the south- east corner. and running parallel to the Plumb Street boundary and intersecting the Wakeforest boundary; and That the east lot line will be the east side lot line; 133 1 ~I That the west side line will be the portion of the Wakeforest lot line beginning at the intersection of Wakeforest lot line and the southern boundary of the previously defined back yard line and ending at the intersection of the Wakeforest lot line and the Plumb Street lot line; In order for the Board to interpret the Zoning Ordinance as it has., it took into consideration the unusual shape of the lot and existing utilities, and in order to protect the City and existing utilities, the interpretation is conditioned upon the owner consenting to a restriction on the building of any structure within 8 ft. of the east property line and that such restriction be filed on record in the Deed Records of Harris County, Texas; and that the interpretation will not go into effect until such restriction is agreed to and filed of record. Mr. Fromen moved the motion, seconded by Mr. Nichols. Voting Aye: Billings Voting No: None Fougerat Fromen McKelvey Nichols Rules of Procedure were reviewed with corrections. The secretary was instructed to re-submit letter dated June 4, 1983, from the Board to the City Attorney along with corrected copy of Rules of Procedure adopted April 27, 1983 with a request fora written opinion on questions contained therein. With no further business to come before the Board, upon motion duly made, seconded and carried the meeting adjourned at 9:30 p.m.. SECRETARY
