HomeMy WebLinkAbout04201983 ZBA Minutes125 REGULAR MEETING ZONING BOARD OF ADJUSTMENT APRIL 20, 1983 The Zoning Board of Adjustment of the City of West University Place. convened in regular session at the City Hall on tiUednesday, April 20, 1983, 7:30 P.M., with the following members present: Chairman. Billings, presiding; Members Fromen, Fougerat, McKelvey, Feazel. Mr. Billings entertained a motion to open the Public Hearing to consider application #83-3 from Mary Anne Templin at: Lot: 5 Block 18 Colonial Terrace Addition 4114 Marlowe Chairman Billings introduced himself and gave his address in the city followed by other Board members; ascertained that notice of meeting had been posted in the City Hall on April 15, 1983, Notice of Public Hearing published in The Houston Chronicle on April 1, 1983 and letters to property owners mailed on March 30, 1983. He also administered an oath to those in the audience desiring to speak on the application for public hearing. Motion by Mrs. Fougerat, seconded by Ms. Feazel,. that public hearing. to consider application from Mary Anne Templin, docketed #83-3, to add. an open air enclosure along the front of the house extending 45 inches farther than the existing houses, Lot 5, Block 18 Colonial Terrace Addition 4114 Marlowe be opened. Voting Aye: Billings Voting No: None Fougerat McKelvey Fromen Feazel Chairman Billings entertained a motion to proceed whereby we use the rules in the last Zoning Board of Adjustment. Fromen made a motion that as a temporary measure that the Board act under the previous rules of the Zoning Board of Adjustment . Ms. Feazel seconded the motion. Voting Aye: Billings Voting No: None Fromen McKelvey Fougerat Feazel 126 Mary Anne Templin - 4114 Marlowe presented plans of her house, plot plan, and survey. An exhibit of pictures of various homes in the West University Place area was presented showing structures which she felt. had been allowed. She stated that she had consulted with all of her neighbor; in her block about her application for a variance and stated that no one had objected to the. project. She asked for 45 inches extending over .the building line. She was remodeling again and planned to install french doors in front of her house. The enclosure was requested for security reasons. She also stated that, in her opinion the addition would enhance the property value. Chairman Billings asked Ms. Templin what she would do if the variance was not granted. Ms. Templin stated that she would place her gate there and install a dead bolt but also stated that this solution would not be as serviceable. An affidavit was presented with the signatures of Ms. Templin's neighbors showing approval of application. hfr. Wayne Perry read Ordinance #34; Front Porch: A front porch is a roofed or unroofed structure attached to the main building and open and unobstructed on all sides other than the main building side. The supporting vertical structure may occupy no more than ten (10) percent of the non-contiguous perimeter of the front porch. Front porches may have a solid or partially open safety rail, provided that the top of the rail is no higher than three feet six inches (3'6") above the front porch floor. Chairman Billings entertained a motion to recess the meeting. Mrs. McKelvey moved to recess the meeting. Fromen seconded the motion. Voting Aye: All Voting No: None Chairman Billings entertained a motion to reopen. the meeting. Mrs. Fougerat motioned, seconded by Fromen to open the meeting. Members reviewed the application and information presented and discussed alternates to the front of house, any hardship involved, enforcement, inter- pretation and reason for setback requirement. Motion by Mr. Fromen, seconded by Mrs. McKelvey, that application #83-3 from Mary Anne Templin be denied, inasmuch as literal enforcement of the ordinance would not cause unnecessary hardship. Voting Aye: Billings Voting No: None Fougerat McKelvey Fromen Feazel Minutes of the regular meeting of the Zoning Board of Adjustment on January 27, 1983 were approved as submitted. After reviewing the minutes of February 16, 1983, the members concluded that the minutes should be rewritten and resubmitted to the Board April 27, 1983. 12'7 0 Chairman Billings requested that the City in the future deliver the minutes to the members as in the past. Chairman Billings requested the Board meet at 6:30 P.M., April 27, 1983 for organizational purposes of the new Board and asked the secretary to post Notice separetely for the 6:30 P.M, meeting. There will be a joint meeting of The Zoning and Planning Commission and the Zoning Board of Adjustment 7:30 P.M., April 27, 1983. Chairman Billings entertained a motion to adjourn the meeting. Fromen moved, seconded by Ms. Feazel to adjourn the meeting. Meeting adjourned 8:45 P.M. Chairman ATTEST ~, Secretary 128 n i
