HomeMy WebLinkAbout09151982 ZBA MinutesREGULAR MEETING ZONING BOARD OF ADJUSTMENT September. 15, 1982 The Zoning Board of Adjustment of the City of West University Place convened in regular session at the City Hall, September 15, 1982, 7:30 p.m. with the following members present: Chairman Mr. Billings, presiding; Members McCandless, Fromen, Kendrick and Fougerat present. Absent: Mr. Loftice. Motion by Mr. Kendrick, seconded by Mr. McCandless that Public Hearing to consider application docketed #82-4 from Mr. Gary Karter for a ~, variance to make an addition to hip house which would encroach 5 feet into the 20 ft. minimum rear back yard located at: West 50' of Lot 10 Block 2 Evanston Addition be opened: Voting Aye: All r 1. 0 Voting No: None The Chairman ascertained from the secretary that notice of Public Hearing had been posted in the City Hall, notice of Public Hearing had. been published in the Houston Chronicle on September 1, 1982, and letters to interested property owners mailed September 7, 1982. Mr. Billings introduced himself and .gave his address in the City followed by other members of the Board and administered an oath to those desiring to speak on the application. Mr. Gary Karter presented his plans to the Board. He stated that his problem was the 20 ft. setback in the backyard. He was requesting a variance of 5 feet. He really needed 10 feet, but had tried to revise his plans to comply with the 5 feet. This would leave a 15 ft. setback in the backyard.. He stated that he had tried to revise his plans in the square footage of his addition as much as possible. Mr. Kendrick and Mr. Billings read from the Code of Ordinances the reasons of how the Zoning Board of Adjustment operates. Mr. Billings explained the backyard area. Mr. Kendrick stated, unnecessary hardship (self imposed) because you desire to build something in which you are breaking the law. Mr. McCandless questioned the Architect, Mr. Flynn, if he was aware of the 20 ft. setback in the rear yard. Mr. Flynn stated that he was not aware of it. Mr. Gary Karter stated that when Mr. Sofia's men came down to get the permit they found out they had a problem. Mr. Billings asked Mr. Kamer if he had done some previous remodeling and how long he had lived at his present address. Mr. Kamer stated that he had lived in this house for two years. Mr. Billings asked Mr. Kamer if we do not grant this request what do 115 1 ~ you plan to do. What alternatives? Mr. Karter stated that his. alternatives were to build up, second story and that it would be financially impossible. He stated that if he could not have the extended 5 feet it would not be feasible to add on to the house. He stated that he did not want to move, he needed the master bedroom and bathroom. Mrs. Fougerat inquired what was the total square footage? Mr. Karter stated it was estimated 750 sq, ft, to add on, another 5 feet. would give an additional 627 square feet. Mr. Karter stated that it was not feasible to do this addition if he had to cut down the sq. ft. Discussion between members and Mr. Karter. Mr. Billings read correspondence: Mr. Perry read Zoning Code: Rear yard; a space, unoccupied except by a building of accessory use, or hereinafter permitted extending for the full width of the lot, between a building other than a building of accessory use and the rear lot line. Section 24-2: Rear Yard - there shall be rear yard along the rear line of the lot. The minimum depth of such rear yard shall be twenty (20) feet. Mr. Kendrick motioned that public hearing be closed. Mr. McCandless seconded the motion. Voting Aye: All Voting No: None It was agreed that there were several alternatives. General discussion began. Mr. McCandless. made a motion to deny application #82-4 request for a variance due to the fact the denial would not result in an unnecessary hardship to the applicant. Mrs. Fougerat seconded the motion. Voting Aye: All Voting No: None Minutes of August 18, 1982 were discussed and corrections suggested. It was agreed that the Secretary would resubmit the corrected minutes of August 18, 1982 for approval. Mr. Billings requested that the minutes reflect the Board reviewed Section 27 of the Zoning Ordinance. Building Inspection Department - that all permits be accompanied by a plan in duplicate and comply with that section. Mrs. Fougerat motioned the meeting be adjourned. McCandless seconded the motion.
