REGULAR MEETING
ZONING BOARD OF ADJUSTMENT
June 16, 82
The Zoning Board of Adjustment of the City of West University Place
convened in regular session at the City Hall, June 16, 1982, 7:30 p.m.
with the following members present; Chairman Billings, presiding;
Members Fougerat, McCandless, Loftice, Fromen.
Motion by Mrs. Fougerat, seconded by McCandless that Public Hearing
to consider application docketed #82-2 from Ruth Billings to relocate air
conditioning compressor unit within the 3 ft, setback from the property
line on:
East 50 feet of Lot 4
Block 47
1Vest University
3320 University
Place 2nd.
Blvd.

The Chairman ascertained from the secretary that notice of meeting had
been posted in the City Hall on June 11, 1982, that notice of Public
Hearing. had been published in the Houston Chronicle on June 9th, 1982 and
letters to interested property owners mailed May 31, 1982.
Mr. Billings introduced himself and gave his address in the City followed
by other members of the Board and administered an oath to those
desiring to speak on the application.

Applicant; Ruth Billings of 3320 University Blvd. stated the reason for
the application was to relocate her air conditioning unit within the
3 ft. setback side building line. When she bought the house two years
ago it was apparent that there was not a good location to place the air
conditioning unit. As far as locating the unit on the West side of the
house along the driveway it appeared not to be feasible as Mrs. Billings
plans to enlarge the very narrow driveway. Also, she stated that it would
be an eyesore and look bad to the neighbors across the street. She stated
that she wanted to move the air conditioning unit to the East side of the
house shown on the diagram within the 3 ft. of the property line. Mrs.
Billings presented photographs to give some perspective as to the way
the front of the house looked and what it would look like. She stated
that a variety of people, including some architects had offered possible
suggestions as to the location of the unit. One option was to move the
unit behind the garage. Ms. Billings had been advised by an air
conditioning company that 90% of units placed more than 50 feet from the
. house develop compressor problems. Another option was to construct the
deck around the unit in back of the house. Ms. Billings plans to build
a $10,000.00 deck and felt that if the unit was so close to the. house it
would be very noisy and make the deck unenjoyable for all. The ideal
solution she stated was to locate the unit around the corner on the
East side as shown on the diagram within the easement. The air conditioning
unit would extend over the easement about 12 feet. She concluded that this

was the rationale for the application for a variance.
Mr. McCandless asked if Ms. Billings was going to use the present unit.
Ms. Billings stated yes, she had bought the unit two years ago and had
installed it directly behind the house.
Mr. McCandless asked if the main reason was the sound.
Mrs. Billings stated no. She was changing the elevation of the house,
opening up all of the back house and using double doors.
Mr. McCandless stated, in other words for convenience. It is in the
way if you open up the'back of the house.
Ms. Billings stated that the unit would be in the way of the double
doors and that part of the remodeling had already been started.
Mr. Loftice suggested that the unit could be screened on the deck.
Mrs. Fougerat said Ms. Billings could move the unit to the corner of the
house and that she did not see any hardship in this application.
Mr. Billings asked do I hear a motion that the variance docketed #82-2
be denied?
Mr. Loftice motioned that application #82-2 for a variance be denied.
Seconded by Mrs. Fougerat.
