HomeMy WebLinkAbout07161980 ZBA MinutesREGULAR MEETING ZONING BOARD OF ADJUSTMENT JULY 16. 1980 61 The Zoning Board of Adjustment of the City of l"pest University Place convened in regular session at the City Ha11 on Wednesday, July 16, 1980, 7:30 p.m., with the following members present: Chairman Doughty, presiding; Members Commander, Fouge- rat and McCandless. Alternate Member Jim Cummings also sat as member. Chairman Doughty ascertained that notice of meeting had been posted, notice of public hearing published and letters to property owners duly mailed. Motion by Mr. Commander, seconded by Mr. Cummings, that public hearing to consider ~, application #80-4 from Robert J. Abel, Jr., owner, to place an air conditioner condenser with the five foot side setback on the side street on Lot 21, Block 16 Colonial Terrace Addition 4235 Coleridge be opened. Voting Aye: Commander Voting No: None Cummings Doughty Fougerat McCandless Mr. Doughty introduced himself and gave his residence in the city followed by other members of the Board, explained the procedure to be followed and administered the oath to those desiring to speak on the application. Mr. Robert (Bob Abel, Jr., owner of the property, stated that he resides at 3521 Plumb, but owns this property which his son will live in when he is married shortly, that his son will be doing. remodeling on the house which is now a duplex and will convert it to a single family dwelling. He stated they desired to demolish the existing garage and construct a new one which would be two feet wider than the one presently existing and that in doing so the area between the garage and the unit, now located between the garage and the rear of the house, would be slightly over one foor and therefore access from the garage and/or driveway was closed to the rear yeard. He stated other options for placing the unit would be at the east bedroom corner where there is an existing tree, in the front of the residence behind the building line, or moved to the southwest corner. These options seemed undesirable as the bedroom corner would adjoin a neighboring bedroom (approximately ten foot separation), the front location would not be .esthetically pleasing, and the south- west corner would be liable to being hit by cars going into and out of the garage and driveway area; and that the. Community St. side of the property was the most de- sirable location. Board members asked questions anddiscussed with Mr. Abel the physical layout of the property and proposed improvements, and it was brought out that a corner of the property had been taken in the widening of Bissonnet on the southwest. Mr. Cummings was called from. the meeting during the above discussion. 62 Building INspector Perry stated that a pemit was denied because the Zoning Ordinance states that no building or structure of any kind shall be constructed within five feet from any street lot line, Motion by Mr. Landless, seconded by Mr. Commander, that public hearing be closed. Voting Aye: Commander Voting No: None Doughty Fougerat McCandless The meeting recessed for five minutes. Board members reviewed the application and presentation: Motion by Mr. Commander, seconded by Mrs.. Fougerat, that application docketed #80-4 from Robert J. Abel, Jr. to place an air conditioning condenser in the setback on the street side of Lot 21, Block 16 Colonial Terrace Addition 4235 Coleridge be denied, by reason of the fact that leteral enforcement of the ordinance would not cause unnecessary hardship and that several options are available to the owner. Voting Aye:. Commander Voting No: None Doughty Fougerat McCandless A written request from Helen and Frederick C. Gardner to withdraw their application docketed #805 scheduled for this time was presented to the Board for consideration. Motion by Mr. Commander, seconded by Mr. McCandless, that the request from Helen and Frederick Gardner to withdraw their application docketed #80-5 be accepted. Voting Aye: Commander Voting No: None Doughty Fougerat McCandless Minutes of the regular meeting of the Zoning Board of Adjustment on May 21, 1980 were approved as corrected. Members discussed the increasing of filing fee .for applications for variances con- sidering publication costs, other city expenses and a recommendation from Building Inspector Perry to City Manager Rockenbaugh to increase the fee to $50 to $75. The Chairman was instructed to write the City Manager that the consensus of opinion of all Board members present was that the fee should be increased to a minimum of $50. 63 With no further business to come before the Board, upon motion duly made, seconded and carried, the meeting adjourned at 8:30 p.m._ APPROVED Secretary Chairman
