• ZONING BOARD OF ADJUSTMENT
MINUTES FROM APRIL 1, 1993
SPECIAL SESSION
7:30 P.M.
The Zoning Board of Adjustment came to order at 7:30 p.m. with the
following members present: Sterling Minor, Chairman, Vic Hansen,
John Pickul, Sue Porretto, and Teresa Fogler. Also present from
the City were Ed Beasley, Building Official, Susan Thorn, Building
Secretary, and Kym Radley, Buildinq Secretary. Members introduced
themselves and procedures were explained.
No residents were present to express opinions regarding any items
that were not on the agenda.
The first and only case on the Docket was 93-06, conc~rning 3620
Albans, Lots 3A & 3B, Block 93, West University Place, 2nd
Addition, a request for variance to allow a fence to be located in
an exclusive easemen"~.
Notices were read and participants were sworn in.
Teresa Fogler made a motion to approve the notices as posted. John
Pickul seconded the motion. Voting was unanimous.
• Mr. Mark Johnson, owner of the property explained that he is asking
for a variance to construct an eight foot high wood fence from the
rear of his property to the front of his property along the Harris
County Drainage Easement flush with the existing chain link fence.
Mr. Johnson explained that if he were to put the fence where
required it would leave a five foot area between the two fences.
This area would be difficult to maintain. Mr. Johnson explained
that for security reasons he also did not want to leave an open
space that would allow someone to walk between the two fences from
Bissonnet street.
Mr. Johnson explained that the Townhouses behind him have built a
fence along the easement. He realizes that if Harris County was to
need access to the the easement, it would be his responsibility to
remove the fence to give it access.
Reed Dillon owner of the house being constructed across the street
spoke in favor of granting the variance. He explained that before
construction of the house began and the i3uilder put the required
fence along the easement line. As a result trash and bottles
accumulated between the two fences.
Mr. Beasley gave the City's point of view. He explained that he
had spoken to George Ruhlen, the Chairman of the Zoning and
Planning Commission regarding this matter. Mr. Ruhlen felt~that
~ this was a technical error made during the writing of the Zoning
Ordinance. The ZPC was trying to prohibit the construction of
Buildings in the easement not light fences. The Zoning Ordinance
does prohibit the construction of masonry fences in any easement.

• Light fences such as wood or chain link would not be prohibited.
No one was present who wished to speak in opposition. No
correspondence was received for or against the variance.
Teresa Fogler made a motion, seconded by Sue Porretto to close the
evidentiary portion of the Hearing.
After a brief discussion Sue Porretto made a motion to grant a
variance to allow a"light fence" to be constructed as all
requirements have been met. The mot~on was seconded by T~eresa
Fogler. Voting was unanimous.
Teresa Fogler made a motion to adjourn e meeting. This motion
was seconded by Sue Porretto. Voting nanimous. The meeting
adjourned at 7:55 p.m. ~
