Applicant's Request The applicant in Docket#2023-0007—3701 Sunset Boulevard,requests that the Board approve a special exception as allowed by Appendix A — Table 7-5a, Note 5, to allow a driveway to be constructed in another location and with a different design than prescribed by the Zoning Ordinance. The applicant wishes to construct a driveway which connects two intersecting streets. Background Information The legal description of the site is LT 20 BLK 1 SUNSET TERRACE SEC 1. The applicant desires to construct a new driveway for their home which connects two intersecting streets (Sunset Boulevard and Edloe Street). The applicant has stated that their intent is to limit on-street parking by providing additional guest/visitor parking in front of their home on the requested driveway configuration. The City curb cut regulations located in the Zoning Ordinance were recently amended to specifically disallow circular driveways which "cut the corner" as desired by the applicant. The curb cut amendments were approved on the consent agenda at the 2nd and final reading of ordinance during the 5/22/23 City Council session. The applicant submitted this project to the City prior to the approval of the amending ordinance and this request for Special Exception shall be reviewed under the prior curb cut regulations that were applicable at the time of project submission(5/10/23). See below for applicable curb cut regulations. Sec. 70-27.—Curb cuts and driveways; concrete. (a) Curb cuts, etc. Only one curb cut and only one driveway is allowed along the front street line of any building site less than 60 feet wide, measured along the front street line. (b) Two or more curb cuts. If there are two or more connected curb cuts for driveways on a buildings site (for example, when there is a circular driveway), the following apply: (1) At the front street line, no part of a curb cut or driveway may be closer than two feet to a side property line. In the street area, no part of the curb cut or driveway may cross the imaginary extension of a side property line, unless the affected neighboring owner consents in writing. The opening width of the driveway and curb cut shall be as specified in table 7- 5(a) in appendix A of the City Code of Ordinances of the City of West University Place; b. The inside edges must be at least 24 feet apart; c. The width of the "island" area may be covered with hard surfaced material if installing a new or replacing an existing public sidewalk; and d. The curb cuts must be located along the front street line. (3) No driveway may be wider than what is allowed or specified in table 7-5a in appendix A of the Code of Ordinances. (4) Within the street area, the edges of each driveway must be perpendicular to the edge of the main traveled roadway. Special Exception Request Appendix A, Article 7, Table 7-5a states as a general rule that every building site, vehicular area and related structure must conform to the applicable regulations shown,by District,in Table 7-5a. Table 7-5a, Note 5 of the Zoning Ordinance authorizes the ZBA to grant a special exception for additional curb cuts,if it finds that all the following circumstances are present: (1) The request is in harmony with the general purpose and intent of the Zoning Ordinance (2) The request will not cause any significant increase in on-street parking or traffic, traffic congestion or an unreasonable burden upon public utilities or services. (3) The ZBA has made any additional findings and determinations required by a specific provision of Section 11-102. (4) The special exception has been reduced to writing and includes any conditions prescribed by the ZBA or required by Section 11-102 for the special exemption in question.
