HomeMy WebLinkAbout09201990 ZBA Minutesr ~ ~ ~ • MINUTES FROM ZONING BOARD OF ADJUSTMENT SEPTEMBER 20, 1990 The Zoning Board of Adjustment hearing came to order at Sterling Minor, Acting Chairman, Doris Marshall, Robert Hansen and John Pickul present. Cecil Boles, Assistant and Diana Wright, secretary,were also present. Members selves and procedures were explained. Notices were rea were sworn in. 7:35 P.M. with Crain, Victor Building Official, introduced them- 3 and participants The first case on the docket was 90-15, 3817 Southwestern. Mr. Les Albin is the builder of this house and he represented Brent & Carole Wells. They are reqesting a variance on the size of the columns allowed on the front porch. The zoning allows a maximum coverage of 107 and they are requesting larger columns to be allowed. Mr. Albin stated that he had already built three (3) homes in West Uni- versity Place with this issue never being mentioned to him and all three homes have more than 10~ coverage of the front porch. John Culpepper, architect of the house, said that the porch would have to be larger than the 2'it'scurrently designed to be to have the size columns they want. Mr. Albin wanted to know what created a hardship and Sterling Minor read him the groundS of a variance. Mr. Albin said he felt he was • keeping with the spirit of the ordinance and the expense of re-designing the plans would create a hardship. He also felt the ordinance should change. The city's view is that Section 7-100-"Projection Schedule" limits the supporting posts on the exposed perimeter of a front porch be limited to 102 of the exposed perimeter distance. Doris Marshall made motion to close the public portion of the hearing. John Pickul seconded and motion carried. The second case on the docket was 90-16, 3324 Pittsburg. Procedures were explained again and members introduced themselves. Notices were read and participants were sworn in. John Culpepper, architect of this porch also, represented Dr. Sidney Wallace, of 3324 Pittsburg~ who could not attend. This house is at the corner of Pittsburg and Westchester. They are requesting to build a porch with columns is excess of the 10' coverage limit. Jane Whitney, 6446 Rutgers, wrote that she has no objections to allowing the variance. Robert Crain seconded and motion carried. Motion was made to have a five minute recess and motion carried. I' - ~ • • Sterling Minor brought the meeting back to order for discussion of the cases. Mr. Minor felt Ehat the ordinance clearly limited the columns to no more than 10~, so what Mr. Albin wanted was not in keeping with the spirit of the ordinance. He also felt there was no hardship, as did Mr. Pickul. Motion was made by Doris Marshall and seconded by John Pickul, to deny the request for variance on the grounds that there is no hardship. All voted in favor and motion carried unanimously.to deny 90-15. Discussion for 90-16 began with Mr. Minor acknowledging the beautiful designs Mr. Culpepper came up with for the Wallaces; but, again there was no hardship. Doris Marshall made motion to deny the request for variance on the grounds that there is no hardship. Victor Hansen seconded and motion carried unanimously. Victor Hansen made motion to adjourn and Doris Mar•shall seconded. Motion carried and the hearing ad~ourned at 9:05 P.M. • •
