THURSDAY, JUNE 6,1996 MINUTES The Building and Standards Commission convened in the Municipal Building, 3800 University Blvd., in the City of West University Place, on June 6,1996 at 6:30 p.m. for a regular session with the following members present: Chairman Craig DuCote, James Colter, John McIntyre, Jim McDaniel and Evelyn Dravis. Absent were Vice-Chairman Craig Hughes, Roy Harper, James Todd and Drew McManigle. Present from the City was Chief Building Official Dennis Holm, Sr. Hearing of Residents: None present. Discussion of fence located at 3102 Albans: Chief Building Official Dennis Holm stated this meeting was requested on behalf of the City • to obtain an advisory opinion due to some unique circumstances in the location of the fence in question. Dr. Arrighi, resident of 3036 Albans expressed her concerns about the newly constructed fence located at 3102 Albans. She stated the new fence is somewhere between six and eight inches higher than the old fence and is located closer than six feet to her house. She stated she felt the fence ordinance should be revised and the measurement should be taken from the edge of the eave of the house. Jim McDaniel asked Mr. Holm if he had measured the height of fence? Mr. Holm stated he had. The fence on the east side grade measured six foot one and a half inches high and on the west side the fence measured six feet ten and a half inches high. Mr. Holm said he measured from the ground up on one side and the driveway on the reverse side. Carol Burke represented the owners of 3102 Albans Pam and Archie Thompson. Ms. Burke presented illustrations and photos of the fence. John McIntyre asked Mr. Holm if the fence had passed inspection. Mr. Holm stated only the fence location inspection had passed. The fence height inspection had not been made. Mr. Holm explained a city crew shot some grade elevations. He stated the lot at 3102 Albans • i` was graded out at the time the driveway was installed and a retaining wall was placed on • either side of the driveway. Jim McDaniel explained Ordinance 1441 states: "a fence may be constructed immediately on the property line or setback three feet from the property line". Dennis Holm stated the fence in this case the fence is on the property line, therefore the grade level would be taken into consideration. Carol Burke stated this fence was placed close as possible to the property due to the fact Dr. Arrighi had a chain link fence already located on the property line. Dr. Arrighi stated the chain link fence was already there when she purchased her property. Dennis Holm stated he was looking for advisory decision of the Building Standards Commission as to what is the grade? Carol Burke stated the issue is the grade along the property line, not the grade where the fence is currently located. Mr. Holm stated if you look on the inside of the fence, it is not fully compacted with dirt, it has been washed out. Dennis Holm stated there is a difference in grade levels. James Collier asked Dr. Arrighi what she felt could be done in order to reach an agreement between she and the Thompsons so the fence would not have to be removed. After a brief discussion James Collier made a motion to grant the variance with the following • stipulations: 1) On the east side of the fence at the top between the top rail an approximate 1 inch by 2 inch piece of treated lumber be fixed to the fence from one end to the other (from north to south) to cover the crack on Exhibit I provided by Carol Burke. 2) On the west side of the fence the rot board shown on Exhibit F be replaced all the way down to prevent water coming from the property to the other side 3) The fence company or property owner will clean up the fence line north to south at the vertical posts on Dr. Arrighi's property as they occur. There are approximately twelve to fourteen vertical posts. This motion was withdrawn by James Collier. Evelyn Dravis made a motion to grant the variance to allow the fence to remain as built, with the stipulation that both property owners reach an agreement, with Jim McDaniel seconded the motion. Annroval of Minutes: James Collier made a motion to approve the minutes from May 2,1996 with Jim McDaniel seconding. Voting aye: Dravis, DuCote, McDaniel, McIntyre and Collier James Collier made a motion to have the City staff study the grade level issue and provide a recommendation to the Building and Standards Commission with Jim McDaniel seconding the motion. Voting aye: • Dravis, DuCote, McDaniel, McIntyre and Collier Voting no: None. Adjournment: James Collier made a motion to adjourn, with John McIntyre seconding the motion.
