HomeMy WebLinkAboutORD 3052 Amending Chapter 46, Motor Vehicles and Traffic relating to ParkingCity of West University Place Harris County, Texas ORDINANCE NO. 3052 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, AMENDING CHAPTER 46, MOTOR VEHICLES AND TRAFFIC, OF THE CODE OF ORDINANCES OF THE CITY BY ADOPTING A NEW SECTION 46-47, "PARKING ON UNIMPROVED SURFACES PROHIBITED"; PROVIDING CERTAIN EXCEPTIONS; PROVIDING FOR SEVERABILITY; REPEALING ANY INCONSISTENT PROVISIONS; PROVIDING FOR A PENALTY NOT TO EXCEED FIVE HUNDRED ($500.00) DOLLARS FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE UPON PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, THAT: SECTION 1. Code amended. Chapter 46, MOTOR VEHICLES AND TRAFFIC, of the Code of Ordinances of the City of West University Place, Texas, is amended by the adoption of a new Section 46-47 to read as follows: "Sec. 46-47. - Parking on unimproved surfaces prohibited; exceptions (a) A person commits an offense if the person parks a motor vehicle upon any area within the front yard or side yard of any private property that is not hard -surfaced pavement or all-weather gravel surfacing. (b) A person commits an offense if the person owns private property and the person causes, allows, permits or suffers another person to park a motor vehicle upon an area within the front yard or side yard of the property that is not hard -surfaced pavement or all-weather gravel surfacing. (c) A person commits an offense if the person parks any motor vehicle or trailer upon any area over the critical root zone of a protected tree and that area is not hard -surfaced pavement or all-weather gravel surfacing. (d) Exceptions. The provisions of this section shall not apply to: 1. city -owned or school district -owned maintenance motor vehicles or trailers; or 2. motor vehicles or trailers during such time as the person is actively engaged in authorized construction, repair, maintenance or mowing work on the property." SECTION 2. Savings provision. Should any, word, sentence, clause, paragraph or provision of this ordinance be held to be invalid or unconstitutional, the validity of the remaining provisions of this ordinance shall not be affected and shall remain in full force and effect. SECTION 3. Repealing provision. That all ordinances or portions thereof in conflict with the provisions of this ordinance, to the extent of such conflict, are hereby repealed. To the extent that such ordinances or portions thereof are not in conflict herewith, the same shall remain in full force and effect. SECTION 4. Penalty. Any person, firm or corporation violating any of the provisions or terms of this ordinance shall be deemed to be guilty of a Class C Misdemeanor and upon conviction in the Municipal Court shall be punishable by a fine not to exceed Five Hundred ($500.00) Dollars for each offense. Each continuing day's violation shall constitute a separate offense. SECTION 5. Effective date. This ordinance shall take effect immediately upon its passage and adoption on second reading and the publication of the caption, as required by the City Charter.
