HomeMy WebLinkAbout06051997 BSC Minutes BUILDING AND STANDARDS COMMISSION REGULAR SESSION CONFERENCE ROOM THURSDAY, JUNE 5, 1997 6:30 P.M. MINUTES The Building and Standards Commission convened in the Municipal Building, 3800 University Blvd. in the City of West University Place on June 5, 1997 for a regular session. The following members were present: Craig DuCote, Jim McDaniel, John McIntyre, Jim Collier and Evelyn Dravis. Absent were Craig Hughes, James Todd, Roy Harper, and Drew McManigle. Present from the City were Fire Chief Terry Stevenson and Building Secretary Susan Thorn. HEARING OF RESIDENTS: No one was present to speak on any matter other than agenda items. PUBLIC HEARING OF COMPLAINT NO. 97-02. CONCERNING PROPERTY LOCATED AT 2809 ROBINHOOD TRACTS 14 & 15A BLOCK 15 MONTICELLO ADDITION: Fire Chief Terry Stevenson updated the Commission on the status of the property at 2809 • Robinhood. Chief Stevenson stated: This property was brought before the Building and Standards Commission previously on March 6, 1997. There are violations of the Standard Housing Code. There are also violations of the roof structure and porch structure. At the March 6 meeting the Building and Standards Commission gave the property owner Mr. McDonald thirty days to make the necessary repairs. I have not had any contact with Mr. McDonald since then. This is a violation of the Standard Housing Code and the Chief Building Official will be handling this." Mr. William McDonald stated, "I am sorry this has taken sixty days. I have removed the porch overhang. I am going to be removing the trash and debris this weekend and I have also contacted a Roofing Contractor about the roof." Chief Stevenson stated, "We brought this back to Building and Standards Commission because Mr. McDonald had not contacted us and had not taken out any permits to have the repairs done. Since this is an inhabited residence we cannot make entry without permission. Mr. McDonald needs to meet with the Building Official Mr. Holm to inform him of what his plans are." Jim McDaniel made a motion to requiring the property owner of 2809 Robinhood to contact the Building Division within ten days to start the process of making the necessary repairs. This motion was seconded by Craig Hughes. Voting aye: Craig DuCote, James McDaniel, John McIntyre, Craig Hughes and Evelyn 1 CHAPTER 22 Urban Forest Preservation and Enhancement • Sec. 22.003. Tree disposition (for building permits); tree surveys (a) General requirement. Every permit for development or pre-development activity must contain tree disposition conditions meeting the requirements of this section. (b) Essential and mandatory conditions Tree disposition conditions aze the most important means of protecting the urban forest of the City from unreasonable harm during development and pre- development activity. Tree disposition conditions shall: (1) Prohibit removal of or damage to any large tree, except): (i) removal of a tree which is diseased, severely damaged or dead maybe authorized; and (ii) damage to or removal of a tree which causes an unreasonable impediment to the use and enjoyment of the applicant's property maybe authorized; and (iii) damage to or removal of a low-value tree maybe authorized. (2) Require replacement trees, to the extent provided in the criteria manual, for any lazge trees authorized to be Damaged or Removed. Exception: No replacement is required for low- value trees. (3) Require protection for large trees (and Critical Root Zones). The conditions may specify the methods of protection to be used. (4) Require that any authorized damage to trees be minimized and mitigated. The conditions may specify methods of mitigation to be used. • (5) Require, if there is major development, that the affected subject site attain a minimum planting standard of tree density as set forth in the criteria manual. (c) Procedure. The building official shall not issue any permit for any development or Pre- development Activity unless all the following have first occurred: (1) Tree Survey. The applicant must have filed a tree survey, and the urban forester must have approved it for compliance with this chapter. (2) Tree Disposition Conditions. Tree disposition conditions approved by the urban forester must have been inserted into the permit. The urban forester may require all persons owning land where a tree is located to agree to any removal of or damage to the tree authorized by the conditions. (d) "Low-impact" exception. Except for the requirement to insert the mandatory conditions, this section does not apply to a subject site, project or other activity that will not have any significant, adverse effect upon any large tree, as determined by the urban forester. h:newtreefonn • J Dravis. • Voting no: None The motion carried unanimously. PUBLIC HEARING OF COMPLAINT NO. 97-01. CONCERNING PROPERTY LOCATED AT 6717 VANDERBILT. TRACTS 5C & 6C. BLOCK 3, WEST UNIVERSITY PLACE 2ND ADDITION: Terry Stevenson stated "First of all I apologize this coming back to you again. There were some changes to the Health and Safety Codes we were not aware of. Our City Attorney Jim Dougherty reviews each order the Building and Standards Commission issues. Mr. Dougherty has since updated our forms so we meet the code. There has been no contact from the property owner Sanford Kahn until today since the March 6, 1997 meet' Mr. Kahn wanted to postpone the meeting tonight because he could not be here~nd I understand he also contacted the Building Division requesting the same thing. Mr. Kahn has told me he has plans for the property." Mr. McDaniel asked, "If we already issued the Order to Demolish why is this coming back to us?" Chief Stevenson explained "The notice we originally sent did not meet all of the legal requirements. We now have forms which will meet those requirements." • Jim McDaniel made a motion to issue an order to demolish the garage structure at 6717 Vanderbilt. This motion was seconded by John McIntyre. Voting Aye: DuCote, McDaniel, McIntyre, Dravis and Collier. Voting No: None. The motion carried unanimously. ADJOURNMENT: Jim McDaniel made a motion to adjourn the meeting, with John McIntyre seconding the motion. Voting aye: DuCote, McDaniel, McIntyre, Dravis and Collier. Voting No: None.
