HomeMy WebLinkAbout03181991 BSC Minutes~ ~~ :~ • BUILDING AND STANDARDS COMMISSION MONDAY, MARCH 18, 1991 SPECIAL MEETING MUNICIPAL BUILDING 3800 UNIVERSITY BLVD. 6:30 P.M. The Building and Standards Commission convened in the Municipal Building, 3800 University Boulevard, in the City West University Place, on March 18, 1991, with the following members present: Philip Lewis, John Farrell, Sharon Mathews, Nick Aschliman, and Dale Reid, also present was Wayne Perry, Chief Building Official. CONSIDERATION OF PROPERTY LOCATED AT 2907 QUENBY: Philip Lewis explained that at the regularly scheduled meeting, Mr. Whittington was asked to bring a termite inspection certificate to the inspection office by Friday, March 15, 1991. Mr. Whittington did not respond by the given time and he wrote a letter to the Building and Standards Commission saying he could not attend the meeting because of work complications. Mr. Perry spoke with Don Nettles of Nettles Extermination, • who said Mr. Whittington has termites in the structure and the normal ground treatment would not be very effective. The termites are swarming and they can migrate to other properties during this time. Mr. Lewis asked if the house is treatable. Mr. Perry said the house is treatable but it will have to be covered with a tent to treat the entire property. Mr. Farrell asked what authority the Building and Standards Commission has in this type of situation. Mr. Lewis said the Building and Standards Commission has the authority to state what must be done to bring the house into structural and health conditions suitable to the Building and health codes. The Building and Standards Commission also has the authority to assess fines up to $1000.00 per day for noncompliance. Mr. Farrell said it appears that the Commission has the option to have the house treated and put a lien against Mr. Whittington's estate for the expense, or begin a pattern of fining Mr. Whittington. Mr. Perry said when the house is treated it will need to be unoccupied for at least 3 or 4 days, and the extermination ~ will be expensive. After a brief discussion, John Farrell made motion seconded by Nick Aschliman to levy a fine to Mr. Whittington of • $100.00 per day until such time that he has treated the house for termites and has provided the Building and Standards Commission with a termite free certificate. This motion includes a provision that the Building and Standards Commission will consider waiving the fines if the inspection and extermination is completed within 2 weeks. Voting Aye: Philip Lewis, John Farrell, Sharon Mathews, Nick Aschliman, and Dale Reid Voting No: None Philip Lewis asked Mr. Perry to find out within the given 2 week period what the power and procedure of the Commission is to evict Mr. Whittington while the house is being treated, what budget restraints the Building and Standards Commission will have, and what the estimated cost would be to exterminate the property.
