BUILDINGS & STANDARDS COMMISSION
THURSDAY, NOVEMBER 7, 1991
MUNICIPAL BUILDING
3800 UNIVER5ITY BLVD.
6:30 P.M.
The Building and Standards Commission convened in the Municipal
Building, 3800 University Boulevard, in the City of West University
Place, on November 7, 1991, for a Regular Session with the
following members present: Nicholas Aschliman, Carolyn Hodgins,
Craig DuCote, Drew McManigle, Dale Reid, Margaret Wallis and Susan.
Freeman. Ed Beasley, Building Official and Susan Thorn, Building
Secretary were present from the City.
HEARING OF RESIDENTS
No residents were present.
APPROVAL OF MINUTES
Carolyn Hodgins made motion to approve minutes, seconded by Drew
McManigle.

CONSIDERATION OF PROPERTY LOCATED AT 4235 AND 4229 SWARTHMORE:
Ed Beasley explained the application for permit was denied because
they wanted to construct a fence around the vacant lot next to
their house to adjoin the two properties on the property line.
Section 6-353 of the Chapter 6 states that any fence construction
on a lot or lots on which no building is located shall be
constructed to comply with all of the setback requirements which
apply to the location of a residence on such lot or lots.
Therefore, the fence would have to be built within the required
setback, instead of on the property line.

Mrs. Francisco Barrionuevo explained that they want to build a
brick column and wrought iron fence to join the two properties
together. That presently people were using the lot to dump trash
After a brief discussion it was determined that because the
Barrionuevo's had already applied for and received a sidewalk and
driveway permit to widen their driveway onto the adjoining property
it was determined that the driveway is a structure and that the lot
' was now an improved lot, therefore no variance would be necessary
and the fence could now be built on the property line.

DISCUSSION OF PROPERTY AT 3117 DUKE:
After a brief discussion of the property at 3117 Duke. Dale Reid
suggested the following actions to be taken:
1) Verify certified letter to Mr. Muhlhausen was received.
2) Investigate property to see if required corrections were or
not made.
3) Notify Mr. Muhlhausen and post notice of action to be taken.
4) Draft letter to Mr. Muhlhausen requesting he attend the next
Building and Standards Commission meeting on December 5, 1991.
DISCUSSION OF FENCES IN VIOLATION OF BUILDING CODE:
After some discussion of fences in violation of the building code
and of clarification of fence heights, it was suggested that in the
near future a special workshop session be scheduled to go over the
Building Code in its entirety. Ed Beasley, said that he would mark
of a copy for inconsistencies and give normals.
Drew McManigle made a motion to adjourn meeting, seconded by Craig
DuCote.
All Voting Aye: Craig DuCote, Drew McManigle, Nicholas Aschliman,
Carolyn Hodgins and Dale Reid.
Voting No: None
The meeting adjourned at 7:40 p.m.
