BUILDING & STANDARDS COMMISSION
THURSDAY, DECEMBER 5, 1991
MUNICIPAL BUILDING
3800 UNIVERSITY BLVD.
6:30 P.M.
The Building and Standards Commission convened in the Municipal
Building, 3800 University Boulevard, in the City of West University
Place, on December 5, 1991, for a Regular Session with the
following members present: Drew McManigle - Vice-Chairman, Carolyn
Hodgins, Craig DuCote, Jeann Howse and Susan Freeman. Terry
Stevenson, Fire Chief, Ed Beasley, Building Official and Susan
Thorn, Secretary were also present from the City.
HEARING OF RESIDENTS
No residents were present regarding any issue other than those on
agenda.
CONSIDERATION OF PROPERTY LOCATED AT 4008 RUSKIN:
Charlotte Muckelroy, owner of property at 4008 Ruskin explained
that because of problems with adjoining neighbors she wished to
build a 7 to 8 foot fence between her property and the property
adjoining at 4004 Ruskin. She felt that this would give her more
privacy and keep the neighbors porch light from shining on her
bedroom windows at night.
Ed Beasley, Building Official explained that because the neighbors
home is less than six feet from the property line the maximum fence
height that could be built would be six feet.
After some discussion Craig DuCote made a motion to grant a
variance to allow the fence to be built two inches back from
property line. This motion was seconded by Jeann Howse.
Voting Aye: Susan Freeman, Craig DuCote, Drew McManigle,
and Jeann Howse.
Voting No: Carolyn Hodgins.

CONSIDERATION OF PROPERTY LOCATED AT 3805 UNIVERSITY:
Mr. and Mrs. Wheeler, owners of property at 3805 University
explained that they had built their fence eight foot in height,
after getting approval from the previous Building Inspection Staff.
They were told if they got their neighbors on the adjoining
properties to sign their permit as to being acceptable for them
to build it higher than the ordinance allowed, they could then
build it eight foot.
They provided a copy of permit showing neighbors signatures (Mary
Guillory and Toraman Sahin).
Mr. Beasley contacted Brent Sherrod, former Director of Engineering
at the City of West University and he verified that he had told Mr.
and Mrs. Wheeler that if they had all the neighbors on adjoining
properties sign the permit as be okay to build fence if they built
in accordance with his instructions.
A copy of the original permits with the signatures is included with
these minutes.
They are asking for a variance to approve existing fence which
previous Building Dept. Administration had approved.
Mrs. La Cook, resident to the rear of the property spoke in
opposition. The portion of the fence adjoining her property is six
foot across except where her house forms an u-shape around her
patio where the fence is eight feet in height. She stated that the
fence blocked out sunlight to her patio.
Motion was made by Jeann Howse, seconded by Craig Du Cote to allow
the fence to remain in place.

DISCUSSION OF PROPERTY LOCATED AT 3117 DUKE:
After a brief discussion regarding garage located at above address
which has been determined to be a dangerous building and has been
an issue on and off the agenda since November of 1990, Craig DuCote
made a motion to demolish garage, which was seconded by Carolyn
Hodgins.

DISCUSSION OF FENCE HEIGHTS:
After some discussion of fence heights. Carolyn Hodgins said she
would like to see inspections of fence to verify height and
locations.
APPROVAL OF MINUTES:
Craig Du Cote made a motion to approve minutes from November 7,
1992, this motion was seconded by Carolyn Hodgins.

The next BSC meeting because of the upcoming holidays will be moved
from January 2, 1991 to January 9, 1991.
A motion was made by Craig DuCote, seconded by Carolyn Hodgins to
adjourn meeting.
