~ BUILDING AND STANDARDS COMMISSION
REGULAR SESSION
3800 UNIVERSITY BLVD.
THURSDAY, OCTOBER 1, 1992
6:30 P.M.
The Building and Standards Commission convened in the Municipal
Building, 3800 University Boulevard, in the City of West University
Place, on October 1, 1992, for a Regular Session with the following
Regular Members present: Nicholas Aschliman - Chairman, Drew
McManigle - Vice-Chairman, Carolyn Hodgins, Susan Freeman, Craig
DuCote, and Alternates Dale Reid and Jeann Howse. Present from
the City were Ed Beasley, Building Official, Chief Terry Stevenson
and Susan Thorn, Building Secretary.
HEARING OF RESIDENTS:
None Present
PUBLIC HEARING OF COMPLAINT N0. 92-02 REGARDING PROPERTY LOCATED AT
3123 AMHERST, TRACTS 2& 3A, BLOCK 3, RICE COURT ADDITION:
Burt Ballanfant, Owner of the property was present. Mr. Ballanfant
explained that he had no objection with his garage being
demolished, except for under a different ordinance requiring
reconstruction within 90 days. He realizes that it needs to be
• torn down and it would have been sooner except for this Catch-22
situation. He is concerned because he knows that he has to
rebuild back the garage after it is torn down. At this time he
would not be able to build it back right away. He is going before
the ZBA to get a variance and he would like the BSC to wait on the
decision of that Board before they act. He has applied for a
variance and the Zoning Board of Adjustments does not meet until
the 15th of October.
Mr. Beasley explained that whether or not Mr. Ballanfant has filed
for a varianCe with the ZBA to not have to reconstruct a garage
within 90 days required by ordinance does not change the fact that
his building has been declared a dangerous building and needs to be
torn down. Mr. Ballanfant can get a permit to tear down the garage
and has ninety days to go before the ZBA and ask for a variance on
the time period required to rebuild the garage. Mr. Beasley
explained that Mr..Ballanfant needs to come down to the Building
Dept. office and file for a Low Impact Exception regarding trees on
the property and after that is approved he can get a permit to
demolish the garage.

• Mr. Ballanfant explained that he has already secured bids on having
the garage building torn down. Mr. Ballanfant explained that he
felt he should be able have the Contractor start tearing the garage
down in about a week, depending on their scheduling.
It was determined by the Board Members that Mr. Ballanfant was
acting in good faith by appearing before the Board and that it
would not be necessary to sign an order to demolish at this time.
No further action would be required by this body other than having
Mr. Ballanfant acquire a demolition permit and proceed with the
demolition of the garage. If this action does not take place in a
timely manner, then the Commission will again take this matter up
for consideration and move it towards a satisfactory conclusion.
The Commission is prepared to call a 5pecial Session to have the
situation resolved as soon as possible as the structure is a hazard
to the residents as well as to anyone in and around this building.
APPROVAL OF MINUTES:
Drew McManigle made motion, seconded by Carolyn Hodgins to approve
minutes from the September 3, 1992 meeting with minor corrections.

Carolyn Hodgins made motion, seconded by Drew McManigle to
adjourn meeting.
