BUILDING AND STANDARDS COMMISSION
REGULAR SESSION
3800 UNIVERSITY BLVD.
THURSDAY, MARCH 4, 1993
6:30 P.M.
The Building and Standards Commission convened in the Municipal
Building, 3800 University Boulevard, in the City of West University
Place, on March 4, 1993, for a Regular Session with the following
Regular Members present: Nicholas Aschliman - Chairman, Drew
McManigle, Carolyn Hodgins, and Alternate, Jeann Howse.
Also present from the City were Ed Beasley, Building Official and
Susan Thorn, Building Secretary.
HEARING OF RESIDENTS:
None Present.
CONSIDERATION OF PROPERTY LOCATED AT 3602 ALBANS, LOT 5a, Block 93
West University Place Addition:
Mr. Buckingham, owner of the property was present. Mr. Buckingham
explained that they want to save the magnolia tree. He explained
that there is really no other place to plant a tree. If the tree
were to die then they would like to have a sidewalk.

Ed Beasley, Building Official gave the City's point of view. Mr.
Beasley explained that this is a new house under construction. The
City has just written changes to the City Ordinance requiring a
sidewalk if there is a sidewalk of the same side of the street. In
this case there is a sidewalk on the same side of the street by the
townhouses which back up to this sidewalk. Unfortunately there is
a magnolia tree growing almost down the property. He felt that it
would hazardous to try to place the sidewalk to go around the tree
because of the elevation of the land where the curb would have to
be placed also. The City is not opposed to the Board granting the
variance. The City is trying to work with the new tree ordinance
and trying to save some trees. Mr. Beasley explained that he would
like to have one stipulation that if this tree were to die that a
sidewalk would to have to placed there and that no other trees be
allowed to be planted there.
After some discussion Drew McManigle made a motion to grant a
variance to Mr. Buckingham to allow him to keep the magnolia tree
with the stipulation that in the future if the tree were to die or
be removed that within 30 days the owner or subsequent owners of
the property would take steps place a sidewalk there. This motion
was seconded by Carolyn Hodgins.
All Voting Aye.
• Drew McManigle made a motion to approve the minutes from the
February 4, 1993 meeting, this motion was seconded by Carolyn
Hodgins.

Drew McManigle made a motion to adjourn the meeting, this motion
was seconded by Jeann Howse.
All Voting Aye.
The meeting adjourned at 7:00 p.m.
