PLACE, TEXAS, APPROVING AN ELECTION AGREEMENT BETWEEN HARRIS COUNTY AND THE CITY OF WEST UNIVERSITY PLACE FOR THE ELECTION TO BE HELD ON NOVEMBER 7, 2006; AND CONTAINING OTHER PROVISIONS RELATING THERETO WHEREAS, the City Council (the "Council") of the City of West University Place, Texas (the "City") has called an election to be held for and within the City on November 7, 2006 (the "E I ecti 0 n"); and WHEREAS, the Council has detelmined that it is advisable to conduct a jOil1t election . with other 'political su.bdivisions within Harris County (the "County") and contract with the County for election services; and WHEREAS, pursuant to the provisions of C.hapters 31 and 271, Texas Electioll Code, the Council has determined that it is in the best interest of the City to enter into an Agreement Between Harris COUllty and the City of West University Place relating to Joint Elections to be held on November 7, 2006 (the "Election Agreement") in substantially the fOnTI. attached hereto; and WHEREAS, the Council finds and declares that the meeting at which this Resolution is co.nsidered is open to the .public, and that the public 110tice of the time, place and .purpose of the .meeting was given., as required by Chapter 551, Texas Govelnment Code, as ame.nded. NOW THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: Section 1. The statements contained ill the preamble of this Resolution are true and correct and are hereby adopted as findings of fact and as a part of the operative provisions hereof. Section 2. Pursuant to the applicable prOVIsIons of the Texas Election Code, including but not limited to Chapters 31 and 271, Texas Election Code, the Council hereby authorizes and approves the Election Agreement, i.n substantially the form attached hereto. Section 3. The Council hereby authorizes the Mayor to sign and the City Secretary of the City to attest the Election Agreement Section 4. The Mayor and other appropriate officials of the City, in consultation with the City Attolney and bond counsel, are hereby authorized and directed to ta.ke any and all actions necessary to implement the Electio.n Agreelnent and comply with the provisiol1S of the Texas Election Code in carrying out and conducting the Election. If ao,y provision, sectio.n, subsectiol1, sentel1ce, clause, or phrase of this Resolution, or the application of this Resolution to any person or set of circumstances is for any reason held to be unconstitutional, void, invalid, or unenforceable, neither the remaining portions of this Resolution nor their application to other persons or sets of circumstances shall be affected thereby, it being the intent of the Council in adopting this Resolution that no portion hereof or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, voidness, invalidity or unenforceability of any other portion hereof, and all provisions of this Resolution are declared to be severable for that .purpose. ~ PASSED AND APPROVED on this the~day of September, 2006.
