A RESOLUTION RELATING TO THE PROPOSED
CONSTRUCTION OF A HIGH RISE APARTMENT COMPLEX ON
SHAKESPEARE STREET ADJACENT TO KIRBY DRIVE AND CONTAINING
FINDINGS AND PROVISIONS RELATING TO THE SUBJECT
WHEREAS, developer Wood Partners has proposed to construct a multi-story
residential complex on Shakespeare Street immediately across Kirby Drive from West
University Place; and
WHEREAS! in the absence of a zoning ordinance, the City of Houston fails to
adequately manage the impact of development particularly on residential property; and
WHEREAS, such a high density, multi-story project is inconsistent with the
existing residential neighborhood housing that extends from West University Place to
the Texas Medical Center; and
WHEREAS, traffic congestion on Kirby Drive is already a substantial concern
that will be exacerbated in the near future when Kirby Drive will be reconstructed; and
WHEREAS, undertaking a massive construction project on Shakespeare at Kirby
will divert traffic into West University Place's residential streets; and
WHEREAS, over 1,500 citizens of Houston and West University Place have
signed petitions in opposition to the proposed project; and
WHEREAS, the proposed project presents problems for sewer, flooding and fire
safety; and
WHEREAS, the proposed project is expected to have a negative impact on
property values in West University Place; and
WHEREAS, Uni.versity Place, Morningside Place and the Wessex subdivision
have taken positions in opposition to the project;
NOW~ THEREFOREt
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1. The City Council formally opposes the construction of a high-density
residential complex on Shakespeare Street across from Kirby Drive.
Section 2. The City Secretary is requested to provide a true copy of this
resolution to the University Place, Morningside Place, Wessex and the City of Houston.
Section 3~ All resolutions and parts of resolutions in conflict with this resolution
are repealed to the extent of the conflict only.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this resolution or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction~
neither the remainder of this resolution, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this resolution to any other
persons or circumstances, shall be affected thereby.
Section 5. The City Council officially finds, determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at which
this resolution was discussed, considered or acted upon was given in the manner
required by the Texas Open Meetings Act, as amended, and that each such meeting
has been open to the public as required by law at all times during such discussion,
consideration and action. The City Council ratifies, approves and confirms such notices
and the contents and posting thereof A
Section 6. This resolution takes effect immediately upon its passage and
signature.
