Resolution No. 2003-01
A RESOLUTION FORMALLY COMMENCING RENEWAL PROCEEDINGS
FOR A CABLE TELEVISION FRANCHISE AND CONTAINING FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT.
Whereas, a representative of Time Warner Cable (TWC) has submitted a letter
seeking renewal of the TWC cable television franchise under 47 U~S~C~ S546;
Whereas, the City has already begun renewal proceedings and desires to
commence them more formally;
NOW THEREFORE~
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1. The City confirms that it has begun the renewal proceedings for the
TWC franchise and adopts this resolution to commence such proceedings more
formally.
Section 2. The working group for the renewal proceedings shall include Council
Member Marilyn Griffin, the City Manager, the Director of Public Works and the City
Attorney~ The City Manager is authorized to support the working group and take all
steps necessary for the renewal proceedings.
Section 3. All resolutions and parts of resolutions in conflict with this resolution
are repealed to the extent of the conflict only.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this resolution or the application thereof to any person or circumstanceJ shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this resolution, nor the application of such word, phrasef
clause, sentencef paragraph, section or other part of this resolution to any other
persons or circumstances, shall be affected thereby~
Section 5. The City Council officially finds] determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at which
this resolution was discussed, considered or acted upon was given in the manner
required by the Texas Open Meetings Act, as amended, and that each such meeting
has been open to the public as required by law at all times during such discussion,
consideration and action. The City Council ratifies, approves and confirms such notices
and the contents and posting thereof.
Section 6. This resolution takes effect immediately upon its passage and
signature.
