RESOLUTION NUMBER 2001-04
RESOLUTION AUTHORlZING PARTICIPATION IN THE STATE OF
TEXAS COOPERATIVE PURCHASE PROGRAM~
WHEREAS, the General Services Commission is allthorized to provid.e
purchasing services for local governments pursuant to TITLE 8~ SUBTITLE C. Cllapter
271, Subchapter D. sections 271~082 and 271.083 of the Local Government Code; a11d
WHEREAS, the City Council of the City of West University Place ("tile City") is
a Local Govermnent defined as an entity qualified to participate ill the Cooperative
Purchasing Program of the General Services Commission purSllant to section 271.081 of
the Local Government Code; and
WHEREAS, ill accordance Witll the requirement of section 113.85(a) of tile
General Services Conunission administrative rules, the Agent(s) of Record, Ro.bert P.
Yelll, City Manager and Walter Thomas, Finance Director is authorized to execute allY
and all documentation for the City pertaining to its participation ill tIle Gelleral Services
Commission Cooperative Purchasing Program; and
WHEREAS~ the City aclmowledges it obligation to pay participation fees
established by the General Services Commission. Now, tllerefore
BE IT RESOLVED, that request be Inade to the General Services Commissiol1 to
approve the City for participatioll in the General Services Cooperative Pllfcllasillg
Program.
Section 1 ~ The facts and recitations contailled in the preamble of tllis resolutiol1
are hereby found and declared to be true and correct.
Section 2. All resolutions and parts of resollltions in conflict l1erewitll are llereby
repealed to the extent of the conflict only.
Section 3 ~ If any word, phrase, clause, sentence, paragrapll, section or other part
of this resolution or the application thereof to any perSOl1 or circumstance, shall ever be
held to be invalid or unconstitutional by any court of competent jurisdictiol1, the
remainder of this resolution and the application of stIch word, pl1Tase, clause, sel1tel1ce,
paragraph, sectioll, or other part of this resolution to lilY otl1er person or circumstallces
shall not be affected thereby~
Section 4~ The City Council officially finds, determines and declares tllat a
sufficiel1t written notice of the date, 11our~ place alld subject of eacll meetil1g at Wllicll this
resolution was discussed, considered or acted upon was given in tIle Inalmer required by
the Texas Open Meetings Law, as amended, and tllat each stlcll meeting l1as beell open to
tIle public as required by law at all times during such discussion, consid.eratiol1 and
action. The City Council ratifies, approves and confirms SUCll llotices al1d tIle COlltellts
and posting thereof~ ~
