HomeMy WebLinkAboutRes 2000-05 Resolution No. 2000-05 A RESOLUTION APPROVING AN APPLICATION TO THE CITY OF HOUSTON FOR "P.E.G." CABLE PROGRAMMING AND AGREEING TO ABIDE BY APPLICABLE ORDINANCES AND ANY AUTHORIZATION GRANTED PURSUANT THERETO; AND CONTAINING FINDINGS AND PROVISIONS RELATED TO THE SUBJECT. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. The City Council hereby: (i) approves an application to the City of Houston for {fP.E.G." cable programming, in substantially the form that is attached to this resolution and made a part hereof, subject to the cover letter that is also attached, and (ii) agrees to abide by the terms of Division 2 of Chapter 37 (Sections 37-221 through 37-227) of the Code of Ordinances~ Houston, Texas and any authorization granted by the City of Houston pursuant thereto~ Section 2. All resolutions and parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict only~ If any VvOrd, phrase, clause, sentence, paragraph, section or other part of this resolution or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of thi s resolution and the app lication of such work, phrase, clause, sentence, paragraph, section or other part of this resolution to any other persons or circumstances shall not be affected thereby~ Section 3. The City Council officially findsJ determines and declares that a sufficient written notice of the dater hour, place and subject of each meeting at which this resolution was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Lawt as amended) and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 4. This resolution shall take effect immediately upon its adoption and signature. This is the new ordinance that Time Warner and our City have worked on together for several years~ We understand that Time Warner is willing to restore the HISD and HCCS channels to the cable system serving West University Place, with the sarre channel assignments as in the City of Houston, if practical~ We also understand that Time Warner would be entitled to increase its rates by 7.5 cents (per subscriber per month) to cover the fees assessed by Houston for the PEG programming, and Tirre Warner would pay the fees directly to the City of Houston when due. If Time Warner shares these same understandings, please: (i) sign the application, the compati bility/interconnection certificate and this letter, (ii) return this letter to us, and (iii) forward the application and the certificate to the City of Houston.
