A RESOLUTION OF IHE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, TEXA.S, DETElUvfiNING THE EXISTENCE OF A
PUBUC NECESSITY FOR A PUBLIC PROJECT TO CONSTRUCT A
STOlU\4 SEWER. CONNECTION FROM EDLOE STREET INTO THE POOR
FARM DITCH; AUTHORIZlNG nm CITY ATTORNEY. OR. ms
DESIGNEE, AND OTHER. CITY OmCIALS TO.T AKE SUCH ACTIONS AS
ARB NECESSARY TO ACQUIRE PERMANENT AND TEMPORARY
EASEMENTS ACROSS PROPERTY LOCATED WITHIN THE CITY BY
DONATION, PURCHASE, OR. OTHER 1\ffiANS; AND PROVIDING AN
EFFECTIVE DATE~
WHEREAS, the City Council recognizes that a public necessity exists for and the public
convenience would be served by the constnlction of a stonn sewer connection from Edloe Street
into the Poor Farm Ditch; and
WHEREAS, the City Council accordingly acknowledges that it is in the public's best
interest to acquire permanent and temporary easements across property located within the City
for these purposes~
NOW, THEREFORE) BE IT RESOLVED BY TIm CITY COUNCIL OF 1HE CITY
OF WEST UNIVERSITY PLACE) TEXAS:

The City Council hereby finds and determines that it is necessary and
proper and in the best interest of the citizens of the City of West Uni~crsity Place to construct a
storm. sewer connection from Edloe Street into the Poor Fann Ditch, all in the City of West
University Place, Harris County) Texas.
Section 2.
A public necessity exists for and the public convenience would be served
by the acquisitio~ by donatio~ purchase, or other means (including. if necessary, the exercise of
the power of eminent domain). of the permanent and temporary easements described in
Exhibit A attached hereto for use in connection with the construction, operation, and
maintenance of the storm sewer connection.

Section :4 ~
The City Attorney or his designee and all other City officials are hereby
authorized and directed, on behalf of the City, to take such actions as are necessary to acquire, by
donation, purchase, or other means (including, if necessary, the exercise of the power of eminent
domain.)~ the perman.ent and temporary easements. described in ~ ~ibit A.
