HomeMy WebLinkAboutRes 1999-13 RESOLUTION NO. 99-13 A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS, NOMINATING A TRANSPORTATION ENHANCEMENT PROJECT FOR FEDERAL FUNDING UNDER THE TRANSPORTATION EQUITY ACT FOR THE 21 ST CENTURY (TEA-21); AUTHORIZING THE FILING OF A PROJECT NOMINATION WITH THE TEXAS DEPARlMENT OF TRANSPORTATION; COMMITTING TO THE FURTHER DEVELOPMENT AND IMPLEMENTION OF A SUCCESSFUL NOMINATION; AND MAKING CERTAIN FINDINGS IN CONNECTION THEREWITH THE ST ATE OF TEXAS ~ COUNTY OF HARRIS 9 CITY OF WEST UNIVERSITY PLACE ~ WHEREAS, the City of West University Place, Texas (the "City"), hereby finds and determines that enhancement of its City Center area as a more safe and inviting place for pedestrians is a significant priority of the community; and WHEREAS, such improvements will enhance the attractiveness of the City Center as a commercial, civic and social destination for the community's residents; and WHEREAS, such enhancements will encourage more walking trips to and from the City Center area and willpfomote more pedestrian activity and interaction there; and WHEREAS, the City is committed to working with the Texas Department of Transportation and oUter involved agencies to further develop, implement, construct, and finance the nominated project and provide for its long-term maintenance with City resources; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY P.LACE, TEXAS, THAT: Section 1. A project nomination is hereby approved and authorized to be filed with the Texas Department of Transportation seeking financial assistance in an amount not to exceed $865,000, with a local match amount not to exceed $220,000, to provide for the costs of constructing pedestrian and aesthetic enhancements in the City Center area. Section 2. The City Manager is hereby designated the authorized representative of the City for purposes of furnishing such information and executing such documents as may be required in connection with the preparation and filing of such nomination for financial assistance and complying with lhe nomination guidelines of the Texas Department of Transporrntion. Section 3~ AIl resolutions and parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict only~ Section 4~ If any word, phrase, clause, sentence, paragraph, section or other part of this resolution or the application thereof to any person or circumstance, shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, the remainder of this resolution and the application of such wordt phrase, clause, sentence, paragrapht section, or other part of this resolution to any other person or circumstances shall not be affected thereby. Section 5. The City Council officially finds, detennines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this resolution was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Law, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action~ The City Council ratifies, approves and confrrms such notices and the contents and posting thereof.
