A RESOLUTION BY THE CITY COUN.elL OF THE CITY O.F W.EST UNIVERSITY
PLACE, TEXAS, NOMINA TIN 0 A TRANSPORTATION. ENHANCEMENT
PROJECT FOR FEDERAL FUNDING UNDER THE TRANSPORTATION EQUITY
ACT FOR THE 21ST CENTURY (TEA-21); AUTHORIZING THE FILING OF A
PROJECT NOMINATION WITH THE TEXAS DEPARTMENT OF
TRANSPORTATION; CO.MMITTING TO THE FURTHER DEVELOPMENT AND
IMPLEMENTION O.F A SUCCESSFUL NOMINATION; AND MAKJNG CERTAIN
FINDINGS IN CONNECTION THEREWITH

WHEREAS, the City of West .University Place, Texas (the "City"), hereby finds and deterl11.ines
that providi.ng more direct and convenient pedestrian access to the City Center area is a significant
pr.i ority of the CQllllll unity; and
WHEREAS, such improved access, together with lllore extensive pedestr.ian-level lighting, will
also prOlllote the safety and well-being of children and adults walking to and froln various activities in the
City Center area; and
WHEREAS, enhanced pedestrian access will cOlnplelnent the City's simultaneous effolts to lnake
City Center a more attractive destination and C01l11TIUnity focal point; and
WH.EREAS, the City is C01TIlnitted to working with the Texas DepaltJnent of Transportation and
other involved agenc.ies to further develop, ilnplenlent, construct, and finance the n0l11inated project and
provide for its long-terlTI 111aintenance with City resources;
NOW, THEREFORE, B.E IT RESO.L V.ED BY T.RE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE, T.EXAS, THAT:
Section 1. A project nOlnination is hereby approved and authorized to be filed with the Texas
Depaltment of Transportation seeking financial assistance in an amount not to exceed $610,000, with a
local 111atch amount not to exceed 155,000, to provide for the costs of constructing improved pedestrian
access to the City Center area via new footbridges, a new sidewalk, landscaping~ lighting, and fencing.
Section 2. The City Manager is hereby designated the authorized representative of the City for
purposes of furnishing such infonnation and executing such dOClllnents as Inay be required in connection
with the preparation and filing of such l101nination for financial assistance and cOlnplying with the
nomination guidelines of the Texas DepartInent of Transportation~
Section 3. All resolutions and parts of resolutions in conflict herewith are hereby repealed to the
extent of the confl iet on Iy.
Section 4. If any word, phrase, clause~ sentence, paragraph, section or other palt of this resolution
or the application thereof to any person or cirCUlnstance, shall ever be held to be invalid or
unconstitutional by any court of COlnpetent jurisdiction, the relnainder of this resolution and the
application of such word, phrase, clause, sentence, paragraph, section, or other part of this resolution to
any other person or circumstances shall not be affected thereby ~
Section 5. The City Council officially finds, determines and declares that a sufficient written
notice of the date, hour, place and subject of each meeting at which this resolution was discussed,
considered or acted upon was given in the manner required by the Texas Open Meetings Law, as
amended, and that each such meeting has been open to the public as required by law at all times during
such discussion, consideration and action. The City Council ratifies, approves and confrrms such notices
and the contents and posting thereof~
