Ordinance No. 1708
AN ORDINANCE RELATING TO SWIMMING POOLS; AMENDING THE CODE
OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS;
AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE
SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1 ~ Section 6.563 (entitled ~(Setbacks, Location, Etc~") of the Code of
Ordinances of the City of West University Place, Texas is hereby amended to read in its
entirety as set out in Appendix A, which is attached and made a part of this ordinance
for all purposes.
Section 2. (a) All findings and recitations in this ordinancej both above and
below the ordaining clause! are officially found and determined to be true and correct
and are officially adopted by the City Council.
(b) All ordinances and parts of ordinances in conflict with this ordinance are
repealed to the extent of the conflict only~
(c) If any word, phrase, clause, sentence, paragraph, section or other part of this
ordinance or the application thereof to any person or circumstance, shall ever be held
to be invalid or unconstitutional by any court of competent jurisdiction, neither the
remainder of this ordinance, nor the application of such word, phrase, clause, sentence,
paragraph, section or other part of this ordinance to any other persons or
circumstances, shall be affected thereby.
(d) The City Council officially finds, determines and declares that a sufficient
written notice of the datej hour, place and subject of each meeting at which this
ordinance was discussed, considered or acted upon was given in the manner required
by the Texas Open Meetings Act, as amended, and that each such meeting has been
open to the public as required by law at an times during such discussion, consideration
and action. The City Council ratifies} approves and confirms such notices and the
contents and posting thereof.
Section 3. This ordinance takes effect on the tenth day following its publication,
as provided in the City_Charter.

Appendix A
Sec. 6.563. Setbacks, location, etc.
In addition to Section 6.405 and Section 6K564 all { XE Uoutdoor swimming pools" }outdoor
swimming pools shan comply with the following regulations, which apply in lieu of other similar
requirements elsewhere in this Code:
(1) No part of the outside wall of any swimmin~ pool.may be closer than five feet to

(2) Adiacent to at least 70% of the perimeter of each swimmin~ poo.l.'t there must be a
walkway~ deck~ apron or other footpath that is: (i) open and unobstructed't (i.i) at
least three feet wide~ and (iii) designed and maintained to allow rapid access to
the water's edge for lifesavin~'t testin~ and maintenance. The setback di.stance
from a property line that is parallel and adjacent to J. street on J. { XE Hco.rner Iof~
learner lot shall be not less than fi"C,'c feet measured from the excavation for the
pool ~~vall nearest that line. Ho\vevcr, the setback distance from the rear lot line
of a corner lot shall be not less than a distance equal to the "C/crticaI depth of the
pool that is nearest and adjacent to the rear lot line (:i.e., an ei.ght foot depth
nearest and adjacent to the rear lot line requires an eight foot distance bct\yccn
the outside pool ~~vall measured from the inside face of the cxcaY3t:ion for the pool
",vall nearest the rear lot line).
(3) A { XE Uwalkway:poolu }walkway, deck or apron around the perimeter of a pool
may be constructed in the area bct\~/ccn the pool ~l1311. and a lot within five feet of
a property line that, if it is contiguous to the pool coping and designed to avoid
water { XE ttdrainage:pools" }drainage to adjacent property.
(4) No pool, pool apron, deck, walkway, pool equipment, or other appurtenances
may be placed or const.ructed in or on any { XE ueasementpooIs" }easement.
(5) The owner must provide, with his appli.cation, an on-ground staked { XE
Hsurvey:poolsu }survey, by a registered professional { XE rtengineerU }engineer
or licensed { XE Hsurveyor" }surveyor, of the lot locating the lot comers, all
property lines, the utility or other easements and the poallocation on the lot prior
to a { XE "permit:pooIH }perrnit being :issued for such construction.
