HomeMy WebLinkAbout03232023 ZBA Agenda Item 2 City of West University Public Works Department Place p To: Zoning Board of Adjustments From: Brian Hunt,Building Official Date: March 23,2023 Re: Staff Report for Docket 2023-0002,3410 and 3416 Sunset Boulevard Applicant's Request The applicant in Docket#2023-0003 for 3410 and 3416 Sunset Blvd., requests that the Board approve a Variance to City's Zoning Ordinance to allow a 10.208' interior side yard setback where 12.25' is required(10% of the building site width, 122.5'). The property owner goal is to build a new home on the subject property, while preserving two existing 18" and 19" oak trees. The proposed encroachment into the easterly interior side yard will be for a single-story three-car garage with no windows toward the adjacent easterly property. Background Information The applicant is intending to combine the subject properties into one building site and build a new single- family residence. This proposed residence has been designed to save two existing oak trees in roughly the middle of this property. This home plan is designed to utilize these trees as a courtyard amenity,whereas a typical design would remove these trees. The setbacks for a residential home are determined by the total width of the building site. In this case, the combining of these lots into one building site would require 12.25' side yard interior setbacks. An important note is that the minimum side yard setback is five (5) feet, but as a building site becomes larger, the interior side-yard setbacks are increased due to the 10% requirements found in Table 7-2; Yards (or setbacks). The applicant is requesting a Variance for the easterly interior side-yard and all other yard requirements will be satisfied. Variance Requests Table 7-2 provides minimum setbacks for required interior and street side yards.The ZBA can grant a Variance only if all the findings from Section 11-102 are confirmed. Any approved Variance may have conditions to lessen the impact of a reduced yard. Section 11-102. - Findings; burden of proof. a) Variances. A"special condition" or"hardship"that is self-created,personal or based only on financial reasons is not sufficient to support the issuance of a variance. (2)The ZBA has made any additional findings and determinations required by a specific provision of this section which relates to the variance. (3)The variance has been reduced to writing and includes any conditions prescribed by the ZBA or required by this section for the variance in question. The State law(Texas Local Government Code Chapter 211)provides, in part: Sec. 211.009.AUTHORITY OF BOARD. (a)The board of adjustment may: ... (3)authorize in specific cases a variance from the terms of a zoning ordinance if the variance is not contrary to the public interest and, due to special conditions,a literal enforcement of the ordinance would result in unnecessary hardship,and so that the spirit of the ordinance is observed and substantial justice is done ... . (b-1) In exercising its authority under Subsection(a)(3),the board may consider the following as grounds to determine whether compliance with the ordinance as applied to a structure that is the subject of the appeal would result in unnecessary hardship: (1) the financial cost of compliance is greater than 50 percent of the appraised value of the structure as shown on the most recent appraisal roll certified to the assessor for the municipality under Section 26.01, Tax Code; (2) compliance would result in a loss to the lot on which the structure is located of at least 25 percent of the area on which development may physically occur; (3) compliance would result in the structure not being in compliance with a requirement of a municipal ordinance, building code, or other requirement; (4) compliance would result in the unreasonable encroachment on an adjacent property or easement; or (5) the municipality considers the structure to be a nonconforming structure. (c)The concurring vote of 75 percent of the members of the board is necessary to: ...
