HomeMy WebLinkAboutOrd 1709 - community center, senior center and library Ordinance No~ 1709 AN ORDINANCE RELATING TO THE COMMUNITY CENTER, SENIOR CENTER AND LIBRARY; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. Cllapter 15 of tIle Code of Ordinances of the City of West University Place, Texas is llereby amended by adding a new Section 15.013 (entitled "Colnmunity Center, Sellior Center and Library"), to read as set out in Appendix A, Wllicl1 is attached and made a part of this ordinance. Section 2. Tllis Ordinance applies from and after the Effective Date~ Section 3. All ordinances and parts of ordinallCeS in conflict with tllis Ordinance are repealed to the extent of the conflict only. Section 4. If any word, phrase, clause, sentence, paragraph, section or other part of tllis Ordil1ance or the applicatioJl tllereof to any person or circumstance, shall ever be 11eld. to be invalid or llllCOl1stitutiol1al by any court of competent jllrisdiction, neitller tIle rel11ail1der of tllis Ordinance, nor the application of SUCll word, phrase, clallse, sentence, paragrapll, sectioll or other part of this Ordil1ance to any other persons or circumstances, shall be affected tllereby. Section 5. TIle City Cou'ncil officially finds, deterlnines and declares tllat a sufficiel1t written notice of tIle date, hour, place al1d subject of eacll meeting at whicl1 tllis Ordinance was discussed, considered or acted upon was given ill the mmmer required by tIle Texas Opell Meetings Act, as aIl1ended, and tllat each suell meeting has been open. to tIle public as required. by law at all tilues during SUCll discussion, consideration and. action~ T.he City Council ratifies, approves atld confirms SUCll notices and tIle contents and. posting thereof. (a) Restricted area~ In tllis section, " restricted area" meallS the entire site Occllpied by tIle COlnmunity Cellter, the Senior Center and Library (gel1erally bounded by Rice Blvd., Allden Street alld Milton Street) together with all sidewalks al1d parking areas adjacellt to tllat site. (b) Activities prohibited~ It sllall be unlawful for allY person to ellgage in any of the following activities witllin tile restricted area: (1) roller skatillg; (2) skateboardil1g; or (3) riding a bicycle. (c) Signs~ At least two signs giving notice oftllis section shall be posted witllin tIle restricted area. It is an affirnlative defense to prosecution llnder tllis section that SllCll signs were . not posted at tIle time of tIle offel1se.
