ORDINANCE NO. 1680
AN ORDINANCE ADOPTING AN AMENDED CODIFICATION OF CIVIL
AND CRIMINAL ORDINANCES; AMENDING THE EXISTING CODE OF
ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS;
ADOPTING PENALTIES; AND CONTAINING FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Sectiol1 1. The City adopts an amended. codification of civil and crimil1al
ordinances as shown in Appendix A, which is attached to the original copy of this
ordinance on file in the office of the City Secretary and made a part h.ereof by reference
for all purposes. The existing Code ofOrdil1ances of tIle City of West University Place,
Texas is hereby amended to read in its entirety as Sl10wn in said Appendix A. TIle City
also adopts tIle various penalties set out in said Appendix A for violations of tIle Code of
Ordinances, as 8lnended, including the following general penalty in Section 1.007 of the
amended Code:
Whenever in this code or in any ordinance of the City an act is prohibited and -is Illade or
declared to be unlawful or an offense or a misdemeanor, or whenever in such Code or
ordinance the doing of any act is required or the failure to do any act is declared to be
unlawful or an offense, and no specific penalty is provided therefore, the violation of any
such provision of this Code or any such ordinance shall be punished by a fine. No fine
shall exceed two thousand dollars ($2,000.00) for violations of all such rules, ordinances
and police regulations that govern fire safety, zoning or public health and sanitation,
including dumping of refuse nor exceed five hundred dollars ($500.00) for all other
violations. No penalty shall be greater or less than the penalty provided for the saine or a
simi.lar offense under the laws of the state. Each day any violation of this Code or of any
ordinance continues shall constitute a separate offense.
Section 2. Tllis ordinance applies from and after its effective date. AllY
violations committed before the effective date are governed .by tIle ordil1ances ill effect
before tIle effective date, and tlley are continued ill effect for this purpose.
Section 3. All ordinances and parts of ordinances in COl1flict l1erewith are l1ereby
repealed to the extenf of tIle conflict only.
Section 4. The City Council officially finds, determil1es aJ.ld declares tb,at a
sufficient written notice of the date hour, place and subject of eacll meetil1g at which tllis
ordinance was discussed, considered or acted upon was given ill the manner required. by
the Open Meetings Law, Cllapter 551, Texas Local Government Code, as alnel1d.ed~ alld
that each such meetil1g has been open to tIle public as reqllired by law at all times dllril1g
such discussion, COl1sideration and action. TIle City Council ratifies, approves 8l1d
confirms such 110tices aIld tIle contel1ts and posting thereof.
Seetioll 5. Tllis ordinance shall become effective all the tellt}l day followillg
its Pllblication, as pr9vided in the City Charter.
