HomeMy WebLinkAboutOrd 1827 - amended codification of civil & criminal Ordinances ORDINANCE NO. 1827 AN ORDINANCE ADOPTING AN AMENDED CODIFICATION OF CIVIL AND CRIMINAL ORDINANCES; AMEN.DING THE EXISTING CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; ADOPTING PENALTIES; AN.D CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. The City adopts an amended codification of civil and criminal ordinances as shown in A.p:pendix A, whic.h is attached to the original copy of this ordinance on file in the office of the City Secretary and made a part hereofby reference for all.purposes. The existing Code of Ordinances of the City of West University Place, Texas is hereby am.ended to read in its entirety as shown in said Appendix A. The City also adopts the various penalties set out in said Appendix A for violations of the Code of Ordinances, as amended, including the following general penalty in Section 1-7 of the amended Code: Whenever in this code or in any ordinance of the City an act is prohibited and is made or declared to be unlawful or an offense or a :misdemeanor, or whenever in such Code or ordinance the doing of any act is required or the failure to do any act is declared to be unlawful or an offense, and. no specific penalty is provided therefore, the violation of any such provision of this Code or any such ordinance shall be punished by a fine. No fine shall exceed two thousand dollars ($2,000.00) for violations of all such rules, ordinances and police regulations that govern fire safety, zoning or public health and sanitation, including dumping of refuse nor exceed five hundred dollars ($500~OO) for all other violations~ No penalty shall be greater or less than the penalty provided for the same or a similar offense under the laws of the state~ Eacll day any violation of this Code or of any ordinance continues shall constitute a separate offense. Section 2. This ordinance applies from and after its effective date. Any violations committed before the effective date are governed by the ordinances in effect before the effective date, and they are continued in effect for this purpose~ Section 3. Ail ordinal1ces and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 4~ The City Council officially finds, determines and declares that a sufficient written notice of the date hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to tIle public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and co.nfinns such notices and the contents and posting thereof. Section 5.
