AN ORDINANCE RELATING TO GAS SERVICE AND CENTERPOINT
ENERGY ENTEX, A DIVISION OF CENTERPOINT ENERGY
RESOURCES CORP.; ESTABLISHING RATES AND TERMS OF
SERVICE; AND CONTAINING FINDINGS AND PROVISIONS
RELATING TO THE SUBJECT
WHEREAS, on December 19, 2003, CenterPoint Energy Entex1 a division of
CenterPoint Energy Resources Corp. (UEntex" or "Company) filed with the City of West
University Place ("City") a Statement of Intent to Change Gas Rates charged to
. consumers in various municipalities within Harris, Montgomery, and Fort Bend
Counties, effective February 1, 2004 ("Application");
WHEREAS, the City, acting as a regulatory authority, suspended the effective
date of the Application in the City in order to study the reasonableness of the
Application. in conjunction with similarly-situated cities served by Entex (UCities");
WHEREAS~ Entex extended the effective date of the Application, which had the
effect of extending City jurisdiction, until August1, 2004; and
WHEREAS, the City, in a public hearing for which reasonable notice was
provided, considered the Company's Application; and
WHEREAS, the City has determined that the Company's rates within the City
should be changed and that the Company's Application should be grantedt in part, and
denied, in part;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST UNIVERSITY PLACE:
SECTION 1. The existing rates and charges of Entex are hereby found, after
reasonable notice and hearing, to be unreasonable and shall be changed as hereinafter
ordered. The changed rates resulting from this Ordinance are hereby determined to be
just and reasonable ra.!.es to be observed and in force within the City.
SECTION 2. For all bills rendered on and after the effective date of this
ordinance:
(1) the IlResidential Serviceu month Iy customer charge shall be $10.50 J and the
residential commodity charge shaU be $0.04600 per CCF; and
(2) the HGeneral Service-Smallu customer charge shall be $18.85 and the commodity
charges shall be as follows:
o -1,500 CCF $0.0850
1,500 - 10.000 CCF $0.0635
over 1 OtOGO CCF $0.0535

SECTION 3~ The Company's proposed early payment discount be modified to
provide customers witl) fifteen (15) days in which to pay a bill, instead of the Company's
proposed ten (10) days, without penalty.
SECTION 4. Entex shalf be required, when filing its next rate application, to
simultaneously file such application with all affected cities in the system serving the City,
and to certify to the City that such simultaneous filing has been accomplished.
SECTION 5~ The Cities' coalition rate case expenses (in an amount not to
exceed $60,000) and Entex's rate case expenses (in an amount not to exceed $20,000)
are found to be reasonable and are approved. The Cities's coalition rate case
expenses shall be reimbursed promptly~ The total of the actual rate case expenses, not
to exceed the approved amounts, shall be divided by the estimated CCF to be
consumed by customers in municipalities located in Harris, Montgomery or Fort Bend
. County (except the City of Houston) over a six-month period. During that six-month
period, the Company may recover the calculated amount, per-CCF1 from its customers
by temporarily increasing the amount charged per CCF. At the end of the six-month
period the Company shall file proof with the City that no overcollection occurred.
SECTION 6. The rates set forth in this Ordinance may be changed and amended
by either the City or Company in any other manner provided by law~ Service hereunder
is subject to the orders of regulatory bodies having jurisdiction, and to the Company's
Rules and Regulations currently on file with the City~ Within 30 days following the
effective date of this ordinance, the Company shall file revised tariff sheets to comply
with ordinance.
SECTION 7~ It is hereby found and determined that said meeting at which this
ordinance was passed was open to the public, as required by Texas law, and that
advance public notice of the time, place and purpose of said meeting was given as
required by law.
SECTION 8~ This Ordinance shall be served on the Company by U.S. Mail to the
Company's authorized representative! Charles J~ Harder, Executive Director of Rates &
Regulatory, CenterPoint Energy Entex, 1111 Louisiana Street, Houston, Texas 77002.
SECTION 9. Nothing contained in this Ordinance shall be construed now or
hereafter in limiting or modifying, in any manner, the right and power of the City under
law to regulate the rates and changes of Entex~
SECTION 1 o~ All ordinances, resolutions, or parts thereof, in conflict with this
Ordinance are repealed to the extent of such conflict only.
SECTION 11. This ordinance shall become effective immediately upon final
passage, approval and signature.
