HomeMy WebLinkAboutOrd 1789 - Portable Buildings Ordinance No. 1789 AN ORDINANCE RELATING TO PORTABLE BUILDINGS; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. Subsection (b) of Section 6.408 of the Code of Ordinances of the City of West University Place, Texas is hereby amended as follows: (b) Public schools. "U"ntil June 1,2002, and 11 Not\vithstanding subsection (a)~ pennits Inay be issued for the erection, placenlent, llse or occupancy of a large portable bui Id ing by a schoo' district having the power of enlinent dOlnain, if a\' of the fol lowing circun1stances are present: (1) (2) (3) the ch ief adlninistrative officer of the district has certified to the City Counci I that such bui lding is necessary for the district to cOlnply \vith state-Inandated teacher-pupi I ratio requirenlents or other app ticable laws.. ru les or regulations, and the district, based on present plans and proj cctions, ~(vi II Jnake eyer)' effort to rCnl0\'C the additional tenlporary bui Id ings~ and the bui Iding is located on a pre-existing school site; and no l110re than ~ 10..000 square feet of gross floor area are, or will be.. included in portable bu i Idings~ large or sn13.\1, on that site (Excevtion: When a building pern1it for construction of pernlanent bu i Id ing space is in effect.. this .[Quare-footage litnitation does not apply to portable bui ld ings llsed for the construction activities or for tenlporary relocation of school activities.) Section 2. All ordinances and parts of ordinances in conflict with this Ordinance are repealed to the extent of the conflict only~ Section 3~ If any word, phrase, clause, sentence1 paragraphl section or other part of this Ordinance or the application thereof to any person or circumstancel shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this Ordinance, nor the application of such wordt phrase, claus81 sentence, paragraph, section or other part of this Ordinance to any other persons or circumstances, shall be affected thereby~ Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this Ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to the public as required by law at all times during such discussionJ consideration and action~ The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 5. This Ordinance takes effect on the tenth day following its publication, as provided in the City, Charter (UEffective DateU).
