HomeMy WebLinkAboutOrd 1751- boards, commissions,and committees City of West University Place, Texas Ordinance No. 1751 AN ORDINANCE RELATING TO BOARDS, COMMISSIONS AND COMMITTEES; AMENDING THE CODE OF ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. Sections 2K 011, 2~ 0 12 and 16.201 of the Code of Ord inances of the . City of West University Place are hereby amended, and a new Section 16~202 is added to such Code of Ordinances, all as shown in Appendix A, which is attached to this ordinance and made part hereof for all purposes. Section 2. All ordinances and parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict only. Section 3. If any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstance~ shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this ordinance, nor the application of such word, phrase, clause, sentence, paragraph, section or other part of this ordinance to any other persons or circumstances, shall be affected thereby. Section 4. The City Council officially finds, determines and declares that a sufficient written notice of the date, hour, place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act! as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action~ The City Council ratifies, approves and confirms such notices and the contents and posting thereof~ The City Council officially finds, determines and declares that sufficient notices of the joint public hearing were given, and the City Council ratifies, approves and confirms such notices, including the contents and the method in which they were given. (a) Perlnanent Bodies; Liaisons. "Pennanent boards, cotntnissions and COlTIlnittees are as follows: (1) Building & Standards COlnlnission. See Chapter 6 of this Code and Chapter 54 of the Texas :Local Gover111nent Code for the C0111Position and duties of this COlTIlnission. The presiding officer shall be selected by the City Council. The staff liaison is the Building Officia"J, or such other person as the City M"anager Inay des ignate. (2) Zoning & Planning Con11nission~ See the Charter and the Zoning Ordinance for the cOlnposition and duties of tl1 is COITIlnissioll and tho presiding officer (~.~trho is elected by the COlTIlnission). The staff liaison is the "B~lilding Official City Planner, or such other person as the City ,Manager lnay designate. (3) Zoning Board of AdjustJnellt. ( 4) Parks & Recreation Board. 9 positions (nulnbered 1 through 9), with position 1 selected by the Board of Directors of the Friends of West University Parks "Fund~ a non-profit corporation ("Friends") [roIn anlong its regular 111elnbers.. and all other positions and the presiding officer selected by the City Counci"l. See Chapter 16 for the duties of this Board and See, also, the provisions of Chapter +6 relating to the Friends of \~1 est UniYcrsit)~ Parks Fund, a non profit corporation. The staff liaison for both the Board and the Fund is the Parks & Recreation Director, or such other person as the City Manager l11ay designate. (5) Senior Services Board: :I 5 positions (l1lunbered 1 through 15), with all positions and the presiding officer appointed by the City Council. The senior services board is responsible for: (i) studying the needs of senior citizens, (ii) assisting with service stud ies and plan develoPlnent and (iii) 111aking recolnnlendations to the City Council on senior citizen progralns~ The staff liaison is the Parks & Recreation staff 111elnber who has principal responsibility for senior citizen progralTIS, or sllch other person as the City M"anager lnay desigllate~ (6) Recycling and Solid Waste Reduction Board: 9 positions (nlllnbered 1. through 9), with all positions and the presiding officer appointed by the City Council. The neighborhood safety board is responsible for (i) studios and rccolTIrTIcndutions 011 public safety, including traffic, and (ii) C0l111llunity education on public safety. (c) Notices of Meetings; Agendas. All boards, cOITIlnissions, COlTIlnittees and task forces are requested to post the date, tiIne and place of their lneetings. If any project requ ires an unusual alTIOunt of staff tirne or Inoney, it should be approved by the City Manager or the City CounciL Only the Mayor, the City Manager or the City Council 111ay authorize the . City Attorney or any outside consultant to provide services for a board, cOITIlnittee, cOlnmission or task force. See.. 2.012. Organizational provisions, certain bodies. (a) Application. This section applies to the pennanent boards, cOITIlnissions or cornlnittees listed in this Chapter, except to the extent otherwise specified in state law, the City Charter or another ordinance (e.g., specific provisions relating to zoning bodies). It also applies to other COlllluittees, COlTIlUissions, and task forces, unless otherwise prescribed by the City Councilor the City Chalter. (b) Positions, Qualifications. Each appointee, at the tilne of appointJnent, 111USt be a resident of the City. A lnelnber who ceases to be a resident of the City shall be deenled to have resigned and Inay be rep laced at any tilne thereafter, but shall continue to serve until a successor is appo i nted and qual ified ~ See, also, "Tcnn Hlnits," belo\v. Each position shall have successive tenns of office, with each ternl beginning on Septen1ber 1 of each odd-ntllnbered calendar year and extending through August 31 of the next following odd-numbered calendar year. Each melnber shall be appointed to a specific tenn, or the unexpired portion thereof, of a specific nUlnbered position. A Inenlber shall also serve after the expiration of a terlTI of office until a SlIccessor is selected and qualified. (d) Appointlnents, Vacancies. Appointlnents for upcorning terms Inay be made no sooner than 60 days prior to the beginning of the terlTI. (f) Officers. Members and officers shall receive no cOlnpensation for their services. This shall not prohib.jt reilnburselnent for actual and reasonable expenses incurred by authority of the City .M.anager or the City Council. (h) QuorU111. Page 4 Amend Section 16.201 and add a new Section 16.202 as follows: Subchapter B. Parks & Recreation Board See.. 16~201.. Created; duties. There is hereby created the parks and recreation board, or npRB~u It shall be organized and governed as provided in Chapter 2 of this Code. In addition to its duties under Chapter 2, the PRB shall: (1) Advise the Parks & Recreation Director or such other person as theCity :M.anager Inay designate ("P&R Director") and the City Council and the City l\1anagcr on Inatters relating to parks and public recreation. (2) Make studies and investigations of park facilities as approved and directed by the P&R Director or the City Council and reCOlTIlnend to the City Council plans for the ilnprovelnent of such facilities to the P&R Director and the City Council. (3) Make studies and investigations of the public recreation progralTI of the City as approved and directed by the P&R Director or the City Council and maIre recolurnendations to the City Council regardin; such progr~lll1 reconllnend plans for itnprovelnents of sllch progralTIS to the .P&R Director and the City Council. (4) In the perfoflnance of its duties set forth in paragraphs (2) and (3) of t"l1 is section~ the PRB~ with the approval of the P&R Director~ lnav: (i) appoint a COlTIlnittee of its melnbers and (ii) recommend that the City Council appoint a task force including both lnembers and non-tnelnbers.
