HomeMy WebLinkAboutOrd 1668 - pavement, street areas and other public places Ordinance No. 1668 AN ORDINANCE RELATING TO PAVEMENT, STREET AREAS AND OTHER PUBLIC PLACES; EXTENDING TEMPORARY REGULATIONS; PROVIDING FOR FEES; CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: S ecti 0 n 1" Th e te m para ry reg u latio n s (relati n 9 to users of street a rea s ~ m u n f ci pa I co n S8 n ts t etc.) imposed by Section 3 of Ordinance No. 1626, adopted October 11, 1999, are extended through and including April 23~ 2001. Exception: The temporary requirement for underground construction does not a p p [y to new or reeo n stru cted faci I ities re r ocated at th e req u est of the City. (b) The permit fee for work under the temporary regulations is $100, plus the estimated out-of- pocket expenses that may be incurred by the City in connection with the work. including engineering review, extra inspections or testing~ supplemental traffic contro]~ etc. The buHding official shall estimate su ch expe n ses at th e ti me of a p p Ii catio n an d s ha rI co Ir ect at least 11 0010 of the es ti mate as a de p os it. Th e . building off[cial may require a permittee to supplement the deposit as the work proceeds. When the work is fjnished, the buUding official shall refund any part of the deposit that exceeds the actual permit fees due in con nection with the work. Fees under this section are su bject to waiver~ incase of conflict or inconsistency with superjor law or franch iS8 ordinancest as provided for other provisions of Chapter 19. Section 2~ Each provision of this Ordinance appHes from and after its Effective Date, as speclfied in Section 6. Any violations committed before the Effective Date are governed by the ordinances in effect immediatery before the Effective Date C'Prior OrdinancesH). If permits (including similar approvals) are affected by this Ordinance. this Ordinance shall generally apply to and govern those appJied-for on or after the appHcable Effective Date~ However, the Prior Ordinances shall apply to and govern any such permit (and the activjties authorized by such a permit) if: ([) the application for the permit is completed and filed before the applicable Effective Date1 with all plans J information ~ fees, etc., (if) the permit Is actually issued on the basis of that application~ and (iii) the permit is not allowed to expire, and is not terminated or revokedr thereafter (although [t may be renewed or extended in the usual manner~ If any, allowed for that type of permit). The Prior Ordinances are continued in effect for the purposes mentioned in this section. Section 3. All ordinances and parts of ordinances in confJict with this Ordinance are repealed to the extent of the conflict only. Section 4. If any wordt phraseJ clause, sentence, paragraphJ section or other part of this Ordinance or the application thereof to any person or circumstance I shall ever be held to be invalid or unconstitutional by any cou rt of competent ju risdiction J neither the remainder of this Ord inance ~ nor the application of such word J ph rase, clause, sentence~ paragraphl section or other part of th [s Ordi nance to any other persons or circu mstancesl shall be affected thereby. Section 5. The City Council officially finds, determines and declares that a sufficient written notice of the date1 hourl place and subject of each meeting at which this Ordinance was discussedJ considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended) and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifiesl approves and confirms such notices and the contents and posting thereof. Section 6. The public importance of this measure and the requirements of the law create an emergency and an urgent public necessity requiring that this Ordinance be passed and take effect as an emergency measuret and a state of emergency is hereby declared. This Ordinance is accordingly passed as an emergency measure and shall take effect as follows: (i) The Effective Date of any finest penalties or forfeitures is the tenth day following publication, as provided in the City Charter, and (ii) the 1 Effective Date of all other provisions is the date of passage and approval.
