HomeMy WebLinkAboutOrd 1671 - election 5/5/2001 ORDINANCE NUMBER 1671 AN ORDINANCE CALLING AN ELECTION WITHIN THE CITY OF WEST UNIVERSITY PLACE, TEXAS FOR THE FIFTH (5th) DAY OF MAY, 2001, FOR THE PURPOSE OF ELECTING A MAYOR AND FOUR COUNCIL MEMBERS; DESIGNATING PRECINCTS AND POLLING PLACES; APPOINTING ELECTION OFFICIALS; CONTAINING FINDINGS AND PROVISIONS RELATING TO SAID ELECTION; AND DECLARING AN EMERGENCY~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS: SECTION 1~ A general election is hereby ordered and shall be held in the City of West University Place, Texas ("City") on Saturday, the 5th day of May, 2001, for the purpose of electing a Mayor and (4) Council Members of said city. SECTION 2. (a) An electronic voting system and puncll-card ballots shall be used for such election. (b) Punch-card ballots, punch-card ballot labels and early voting ballots for tIle general election shall be prepared in accordance with the applicable provisions of the TEXAS ELECTION CODE (ill English and in SpaJ.lish) so that the voters lnay cast tlleir ballots for the candidates of their choice by making a punch hole in the space provided adjacellt to the l1ame of that candidate. (c) The City Council hereby appoints a Presiding Judge, Gene De Laveaga for tIle Central Counting Station, which for purposes of this election shall be located at the West University Place MUl1icipal Buildin.g, 3800 University Boulevard. Victor Hansen shall serve as the Manager of the Central Counting Station and Kaylynn Holloway as Tabulatiol1 Sllpervisor for the election~ Said appointments are made for this electiol1 only. (d) The appropriate election officials shall conduct a test of tIle automatic tablllating equipment on Wednesday, May 2, 2001 at 4:30 p.m. in the COUI1Cil Cllambers at the MUlllcipal Building, 3800 University Boulevard, West University Place, Texas 77005, open to tile public. SECTION 3. (a) The City shall be divided into four elections precincts for the electiol1, and tIle polling place designated for each election precinct and the perSOllS 11ereby appointed to serve, for this election only, as Presiding Judge atld Alternate Presidil1g Judge for eacll polling place, are as follows: Voting Precinct # 183 West University Comm~nity Building/Senior Wing 6104 Auden H. For pllrposes of processillg early voting results, tile precinct election officers serving Precillct # 15 sllall serve as the Early Voting Ballot Board for this election. SECTION 4: All qualified electors of the City sIla!1 be permitted to vote at said electioll. Not witllstanding any provisiol1S to the contrary ill tllis ordinance, this election shall be l1eld alld conducted in accordance with tile TEXAS ELECTION CODE, and, as may be reqllired by law, all election materials and proceedings shall be printed in bot11 English and Spal1isll~ SECTION 5: The form of the notice prescribed by tIle Secretary of State's Office of tIle . State of Texas sllall serve as proper notice of said election. Said llotice, including a Spanisll translation thereof, shall be given by publislling it and posting it in accordance witll Section 4.003, of tIle TEXAS ELECTION CODE. SECTION 6: The Mayor, the Mayor Pro Tern, the City Manager, tlle City Secretary llild the Assistant City Secretary, or anyone of them, are authorized on behalf of tIle City COUIICil to evidence adoption of this Ordinance and to do any IDld all other tllil1gS legal and. l1ecessary ill COllilectiol1 witll the holding and consummatiol1 of suell electiol1 and to give effect to the illtellt of this Ordinance. SECTION 7: If any word, pInase, clause, sentence, paragraph, sectiol1 or other IJart of tllis ordinance or the application thereof to any person or circumstaI1Ce, s11all ever be l1eld to be invalid or llnconstitutional by any court of competent jllrisdictio"n, l1eitller tIle remail1der of tllis ordinilllce, nor the application of suell word, plrrase, clallse, sel1tellce, paragrap11, sectioll or otl1er part of this ordinance to any otller persons or cirCU111stmlces, Sllall not be affected tllereby. SECTION 8: All ordil1ances and parts of ordinances in conflict 11erewith are l1ereby repealed to the extent of the conflict only. SECTION 9. TIle City Council officially finds, deternlilles al1d declares tIlat a sufficiellt written notice of the date, hour, place and subject of each meeting at Wllich this ordil1al1ce was discussed, considered or acted upon was given in tIle manner reqllired by tile Texas Opel1 Meetings Act, as amended, and that each such meeting has been open to the public as reqllired by law at all times during such disCllssion, consideration and action. The City COl111Cil ratifies~ approves and confirms such notices and the contents alld postillg thereof. SECTION 10: The public importance oftllis measure and tIle reqllirelnents of the law create an emergency and an urgent public necessity requiril1g that this Ordil1ance be passed illld" take effect as atl emergel1cy measure, and a state of emergency is l1ereby declared. This Ordinance is accordingly passed as an elnergency measure and shall ta!(e effect inunediately upon adoption and signatlrre.
