HomeMy WebLinkAboutOrd 1707 - zoning; amending #1672 Ordinance No. 1707 AN ORDINANCE RELATING TO ZONING; AMENDING ORDINANCE NO. 1672 OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS TO INCLUDE A PREVIOUSL Y MADOPTED FOOTNOTE; AND CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT. WHEREAS, Ordinance No~ 1672, passed on second and final reading on March 12, 2001, adopted and re-adopted the City's existing zoning ordinanceJ with amendments; and WHEREAS, a previously-adopted footnote in the existing ordinance was inadvertently omitted from the re-adopted version; and WHEREAS, there being no intention to exclude the footnote, the City Council desires to amend Ordinance No. 1672 to indicate, correctly, that the footnote was to be included; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1. Exhibit A of Ordinance No. 1672, passed on second and final reading on March 12, 2001, is hereby amended as foHows: (1) Insert a reference to "Note 411 in Table 7 -5b beneath the item HAil structures~ n (2) Include the following UNote 4" at the end of Table 7 -5b: Note 4. Utility Poles. An ordinal)' utility pole o\vned by a franchisee of the City (nay be up to 43 feet hjgh~ if the building official certifies that the additional height is necessary to separate wires of different voltages and capacities from each other and from the ground) applying standard technical codes and utility safety guideli11es. Section 2. (a) All findings and recitations in this ordinance, both above and below the ordaining clause~ are officially found and determined to be true and correct and are officially adopted by the City CounciL (b) All ordinances and parts of ordinances in conflict with this ordinance are repealed to the extent of the conflict only & (c) rf any word, phrase, clause, sentence, paragraph, section or other part of this ordinance or the application thereof to any person or circumstancet shall ever be held to be invalid or unconstitutional by any court of competent jurisdiction, neither the remainder of this ordinance, nor the application of such word, phrase, clause, sentence~ paragraph, section or other part of this ordinance to any other persons or circumstances, shan be affected thereby. (d) The City Council officially finds, determines and declares that a sufficient written notice of the d~te, hourf place and subject of each meeting at which this ordinance was discussed, considered or acted upon was given in the manner required by the Texas Open Meetings Act, as amended, and that each such meeting has been open to the public as required by law at all times during such discussion, consideration and action. The City Council ratifies, approves and confirms such notices and the contents and posting thereof. Section 3.
