Ordinance No~ 1847
AN ORDINANCE CANVASSING THE RETURNS AND DECLARING
THE RESULTS OF THE GENERAL ELECTION AND SPECIAL
ELECTION HELD IN THE CITY OF WEST UNIVERSITY PLACE,
TEXAS, ON MAY 12, 2007; CONTAINING FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN El\IJERGENCY.
WHEREAS, on Febnlary 12, 2007, the City Council of the City of West University
Place, Texas, (the "City") adopted Ordinance No.. 1841, which ordered that a general election be
held in the City on May 12, 2007, for the purpose of electing one Mayor and four Council
Members for a two year term; and
WHEREAS, the City Council, by the adoption of said Ordinance No.. 1841 and No. 1845,
also called a special election--to be conducted jointly and concurrently with the May 12, 2007
general election--for the purpose of submitting proposed City Charter amendments and a
proposition to the qualified voters of the City, as authorized by Section 9..004 of the Texas Local
Government Code, which amendments were submitted, on the Council1s own motion, to amend
the City Charter as follows:

would be in the Charter if the amendments are adopted. Words to be added are typically shown by dmil:2k.

PROPOSED CHARTER AMENDivIENTS
Amend S ectiolZ 2.05 of the Cha rler as Jollo ws:
Section 2.05. Vacancies.
a. 'y1!hen a ~/ucancy is declared, a special election to fill the office shall be ordered
for the first election date permitted under State la'Et~,~ that is at least 45 days after the
first public notice of such order, except as provided in Section 2~05b. Condidutcs
must qualif~y according to Section 2.02~
b~ If pursuant to Section 2.05a, a special election to fill a "Vacant office or offices
y.",ould be held on the permitted election date immediately preceding the regular
election of members of the Council, then no special election under Section 2.05a
shall be required, unless the fiye member Council is left Yl/ith fC'E.vcr than three
members.
If at anv time a vacancv exists on the Council.. Council shall fill the vacancy with an aooointment
bv a maioritv vote of the remaininl! Council mem.bers.. with such appointee to serve until the next
re2:l11arlv scheduled election.. provided.. however;, that if such vacancv is not filled bv Council
within 60 davs.. then sllch vacancv shall be filled bv soecial election. Anv oerson aODointed or
elected to the Council under this orovision.. shall meet all oualifications to serve as a Council
member uD.clef Section 2.02 as of the date of such annointment or election.
Amend Section 2.09 of the Charter as follows:
Section 2.09. Meetings of Council.
a. The Council shall hold at least two regular meetings each month at a time the
Council shall designate..
b. Regular meetings are Council meetings required to be held semi-monthly and
designated as regular.. All reQ:ular meetinlrs shall be held within the Citv limits.
c. Special meetings may be called by the City Secretary at the request of the Mayor
or two members of CounciL The City Manager shall be notified of all special
meetings.. Snecial meetinQs mav be held in the City or other nlaces within Harris
Countv.
d. All meetings of Council shall be open to the public except as authorized by law
and shall be held at the ,\llcst Uni'l'/ersity Place City Hall or other pluccs 'El'~,'ithin the
City limits '.vhich ~.vill permit the attendance of the general public~
Amend Section 3~06 of the Cha.rter as follows:
Section 3.06. Petitions, Qualified Voters, Etc.
The Texas Election Code shall govern petitions filed by candidates for office and other
similar petitions, including petitions for initiative, referendum and recall. Any additional
requirements prescribed by this Charter shall also apply~ The number of qualified voters of the
City, if required to determine the number of signatures needed on a petition, shall be determined
by the City Secretary.. Determinations shall be made as of the date of the earliest signature on a
petition.. For this purpose, the City Secretary may rely upon the most recent poll list, or other
official list of registered voters as may be on file with the City ~
Amend Section 5.05 of the Charter as follows:
Section 5.05. Zoning Board of Adjustment: Composition.
There shall be a Zoning Board of Adjustment which shall consist of five members and YR
to four alternates, unless otherwise required by state law. All members are appointed by the
Council.. The Council, by ordinance, shall provide for the organization and functions of the
Board and all other necessary matters, in accordance with applicable laws and this Charter.
Amend Section 6.01 of the Charter as follows:
Section 6.01. City Manager: Appointment, Removal, and Compensation.
The Council shall appoint a City Manager who shall be the chief administrative officer of
the City.. The City Manager shall be chosen by the Council solely on the basis of execlltive and
administrative training, experience, and ability. The City Manager shall serve at the pleasure of
the Council and may be removed by a majority vote of Council Members qualified and serving.
The action of the Council in removing a City Manager shall be final; all authority and
responsibility to remove the City Manager is vested in the CounciL The City Manager is entitled
to compensation as established by the COllnciL The Council shall designate a qualified perso"n to
perform the duties of the City Manager during the absence or inability of the City Manager~ No
member of the Council may, dllring the member's term of office or for two years thereafter, serve
as the City Manager.
The City Manaller mav desirnate one or more department heads to serve as Assistant
Citv Mana2:ers for an indefinite term with the approval of Council. Suc"h Assistant Citv
Managers mav be removed from office bv the Citv Mana2:er after consultation with the Council.
Should the Citv Manafler's Dosition be vacant.. the Council mav remove the Assistant City
Manai!er desi!!nation from anv individtlal oreviouslv so desie:nated without affectini! the
individual's position as a deoartment head.
A,nend Section 10.07 of the Charter as follows:
Section 10.07. Notice of Claim~
The City shall not be held liable for the death of or injury to a person, or for damage to
property, unless the claimant or legal representative files a written statement of claim with the
City Secretary within 100 days six (6) months after the event alleged to have caused the death,
injury, or damage. The statement must describe the nature and extent of the injury or damage;
describe the place and circumstances of the alleged causal event; itemize by monetary amount
the injury and damage; and, for personal injuries, name witnesses, if any, to the event
Proposition: Proposed Changes in Compensation
Ratification of an increase in compensation for service as Mayor or as a Council
Member of the City of West University, as required under Section 2.04 of the Home
Rule Charter of the City of West University Place, Texas. The proposed compensation
changes are as follows:

WHEREAS, said elections were called and notices were given in accordance with
the law, and the elections were held in all material respects in conformity with the law;
and
WHEREAS, the returns of such elections have been duly and legally made and
submitted to the City Council, and the City Council has examined such returns, including
the tabulation attached hereto as Exhibit A and made a part hereof for all purposes;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNNERSITY PLACE:
Section 1. All of the recitals contained in the preamble to this Ordinance are
found to be true and are adopted as findings of fact by this City Council and as part of its
judgment, particularly the tabulation of returns of the elections set out in Exhibit A..
Section 2. (a) The City Council now formally canvasses the returns of such
elections, and it is hereby adjudged, determined and declared that:
(I) Bob Kelly, with a total of 1,199 votes cast for him, has been elected MAYOR of the City
of West University Place, Texas; and
(2) Bob Fry, with a total of 1,021 votes cast for him; Chuck Guffey, with a total of 836 votes
cast for him; Phyllis Cohen, with a total of 818 votes cast for her; and Michael
Talianchich, with a total of 757 votes cast tor him; have been elected COUNCIL
MEMBERS of the City of West University Place, Texas; and
(3) 1184 qualified voters of the City, being more than a majority of the qual ified voters of the
City voting at said election~ have voted for and approved the proposed amendment to
Section 2.05 of the Charter set out in the preamble of this Ordinance; such proposed
amendment has been adopted~ and the Charter of the City is amended as provided in such
amendment; and
(4) 1349 qualified voters of the City, being more than a majority of the qualified voters of the
City voting at said election, have voted for and approved the proposed amendment to
Section 2.09 of the Charter set out in the preamble of this Ordinance; such proposed
amendment has been adopted; and the Charter of the City is amended as provided in such
amendment; and
(5) 1445 qualified voters of the City, being more than a majority of the qualified voters of the
City voting at said election~ have voted for and approved the proposed amendment to
Section 3.06 of the Charter set out in the preamble of this Ordinance; such proposed
amendment has been adopted; and the Charter of the City is amended as provided in such
amendment; and
(6) 1221 qualified voters of the City, being more than a majority of the qualified voters of the
City voting at said election, have voted for and approved the proposed amendment to
Section 5.05 of the Charter set out in the preamble of this Ordinance; such proposed
amendment has been adopted; and the Charter of the City is amended as provided in such
amendment; and
(7) 1293 qual ified voters of the City ~ being more than a majority of the qual ified voters of the
City voting at said election~ have voted for and approved the proposed amendment to
Section 6.01 of the Charter set out in the preamble of this Ordinance; such proposed
amendment has been adopted; and the Charter of the City is amended as provided in such
amendment; and
(8) 1445 qualified voters of the City, being more than a majority of the qualified voters of the
City voting at said election, have voted for and approved the proposed amendment to
Section 10.07 of the Charter set out in the preamble of this Ordinance; such proposed
amendment has been adopted; and the Charter of the City is amended as provided in such
amendment; and
(9) 1247 qual ified voters of the City, being more than a majority of the qual ified voters of the
City voting at said election, have voted for and approved the proposition concerning the
proposed changes in compensation set out in the preamble of this Ordinance.
(b) This Ordinance shall constitute the official act of the City Council in
examining, counting, and declaring the results of the charter amendment election of May
12, 2007, and it shall further constitute the order of the City Council required by Section
9.005 of the TEXAS LOCAL GOVERNMENT CODE. This Ordinance shall be signed
and immediately entered into the records of the City, whereupon the proposed
amendments to the City Charter takes effect as provided in said Section 9~005. The City
Secretary shall endorse this Ordinance to indicate when this Ordinance is entered into the
records of the City and takes effect The Mayor or chief executive officer of the City
shall certify the amendment to the secretary of state as provided in Section 9.006 of the
TEXAS LOCAL GOVERNMENT CODE.
Section 3. The City Secretary is hereby authorized and directed to make the
appropriate entries of information in the election register maintained by the City in
accordance with provisions of Section 67..006 of the TEXAS ELECTION CODE.
Section 4. If any word, phrase, clause, sentence, paragraph, section or other part
of this ordinance or the application thereof to any person or circumstance, shall ever be
held to be invalid or unconstitutional by any court of competent jurisdiction, the
remainder of this ordinance and the application of such word, phrase, clause, sentence,
paragraph, section or other part of this ordinance to any other persons or circumstances
shall not be affected thereby.
Section 5. All ordinances and parts of ordinances in conflict herewith are hereby
repealed to the extent of the conflict only.
Section 6. The City COllncil officially finds, determines and declares that a
sufficient written notice of the date, hour, place and subject of each meeting at which this
ordinance was discussed, considered or acted upon was given in the manner required by
the Open Meetings Law, as amended, and that each such meeting has been open to the
public as required by law at all times during such discussion, consideration and action~
The City Council ratifies, approves and confirms such notices and the contents and
posting thereof.
Section 7. The public importance of this measure and the requirement of the law
create an emergency + and an urgent public necessity requiring that this ordinance be
passed and take effect as an emergency meaSllre, and a state of emergency is hereby
declared. This ordinance is accordingly passed as an emergency measure and shall take
effect immediately upon adoption and signature.
