Ordinance NOR 1852
AN ORDINANCE RELATING TO WATER RATES; AMENDING THE FEE
SCHEDULE OF THE CODE OF ORDINANCES OF THE CITY OF WEST
UNIVERSITY PLACE, TEXAS; AND CONTAINING FINDINGS AND
PROVISIONS RELATING TO THE SUBJECT.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
UNIVERSITY PLACE:
Section 1. The Fees & Charges Schedule of the Code of Ordinances of the City
of West University Place, Texas is hereby amended to read in its entirety as set out in
Appendix Af which is attached and made a part of this ordinance.
Section 2. This Ordinance applies from and after the Effective Date. New or
changed water rates and charges shall apply to each billing period beginning on or after
the Effective Date. For prior billing periods, the fees and charges in effect immediately
before the Effective Date ("Prior Fees") shall govern~ The Prior Fees are continued in
effect for this purpose.
Section 3. All ordinances and parts of ordinances in conflict with this Ordinance
are repealed to the extent of the conflict only.
Section 4. If any word, phras8J clause, sentence, paragraph, section or other
part of this Ordinance or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this Ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this Ordinance to any other
persons or circumstances, shall be affected thereby.
Section 5. The City Council officially finds, determines and declares that a
sufficient written notice of the date, hourJ place and subject of each meeting at which
this Ordinance was discussed, considered or acted upon was given in the manner
required by the Texas Open Meetings Act, as amended, and that each such meeting
has been open to the public as required by law at all times during such discussion,
consideration and action. The City Council ratifies~ approves and confirms such notices
and the contents and posting thereof.
Section 6. This Ordinance and shall take effect after September 30, 2007
("Effective Date").

Fire s ys terns
Plan checking fee: $100 per set for original submission, $50 for re-submission (not
credited to permit fees). Permit fees are $50 for each automatic fire extinguishing
system and each alarm and detection system. For sprinkler systems~ the fee is increased
by either $25 (residential) or $50 plus $1.75 per head (non-residential). Fire system fees
are payable in addition to all other fees.

Exception.: The permit fee for work affecting new road ways under Chapter 19 is $100,
plus the estimated out-af-pocket expenses that may be incurred by the City in
connection with the work., including engineering review, extra inspections or testing,
supplemental traffic control, etc. The building official shall estimate such expenses at
the time of application and shall collect at least 110% of the estimate as a deposit. The
building official may require a permittee to supplement the deposit as the work
proceeds. When the work is finished, the building official shall refund any part of the
deposit that exceeds the actual permit fees due in connection with the work.

'nstitutional Exchanges. The Parks & Recreation Director may waive all or part of the Parks & Recreation fees
prescribed by this section, subject to the following regulations: (1) The applicant must be an institution, either
public or non-profit, with facilities located within the City. (2) The portion of the fees waived may not exceed the
value of facilities made available by the institution to the City for public use (e~g., for meetings, elections,
emergency operations, etc.). (3) The maximum amount of fees that may be waived is $500 per institution per yeaL
(4) Passes and permits issued to an institution under this section may be assigned or resold by the insti tution, but
the actual user must qualify for the type of pass or permit in Question, and the City must be notified.

p.021 ZONING & PLANNING COMMISSION
Plats and rep lats
The fee is the City's actual cost of plat review, plus incidentals. The
eview is done by a planner retained by the City or by City staff.
[ncidentals include legal notices, surveys, title and legal work,
esearch, signature requests, recording, copies, etc., as may be
equired and not provided by the applicant.
DEPOSIT. A deposit amount (due with the preliminary application)
is estimated by the City staff, but the minimum deposit is $500 base
fee (or $200.00 base fee for amending plats only), plus $1 O~OO for
E lot and reserve shown on the plat or replat, plus $100 for those
equiring newspaper legal notice, plus $1 OO~OO for each separate
legal instrument needed (easements, etc.)
DITIONAL DEPOSIT. An additional deposit of $1.00.00 ($50.00
~or amending plats) is due each time the plat is resubmitted for
rechecking.
fULL P A YIvIENT. The full actual cost must be paid before the
replat is released for recording.

Refunds No fees or costs are refundable unless: (i) the applicant prevails, (ii)
he ZBA reverses or modifies an administrative interpretation or
other decision; and (iii) the ZBA determines that a refund (full or
partial) would be just and equitable under the facts and circumstances
of the case.
