Ordinance No. 1805
AN ORDINANCE RELATING TO HOMELAND SECURITY AND THE
NATIONAL INCIDENT MANAGEMENT SYSTEM; AMENDING THE CODE OF
ORDINANCES OF THE CITY OF WEST UNIVERSITY PLACE, TEXAS; AND
CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT.
WHEREAS, on February 28, 2003, the President issued Homeland Security
Presidential Directive (HSPD)-5 that directed the Department of Homeland Security, in
cooperation with representatives of Federal, state, and local government, to develop a
National Incident Management System (NIMS) to provide a consistent approach to the
effective management of situations involving natural disasters; man-made disasters or
terrorism; and
WHEREAS, the final NIMS was released on March 1,2004, and
WHEREAS, the NIMS contains a practice model for the accomplishment of the
sign ificant responsibilities associated with prevention, prepared ness, response,
recovery, and mitigation of all major and national hazards situations, and
WHEREAS, the HSPD-5 requires that state and local governments adopt the
NIMS by fiscal year 2005 as a pre-condition to the receipt of federal grants, contract
and activities related to the management and preparedness for certain disaster and
hazard situations: and
WHEREAS, the City Council for the City of West University Place) Texas desires
to adopt the NIMS as required by HSPD-5;
NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST
Uf\UVERSITY PLACE:
Section 1. The City hereby adopts the National Incident Management System
dated March 1, 2004~
Section 2. The Code of Ordinances of the City of West University Place, Texas
is hereby amended by adding a new Section 7.021 which shaH read as follows:
Sec. 7.021. National Incident Management System.
The City adopts the National Incident Managelnent SystelTI published by the U. s~
Departn1ent of HOlneland Security and dated March 1, 2004 ("NI.MS"), in accordance with
Homeland SeCllrity Presidential Directive ("HSPD")-5. A copy of the adopted NIMS

Section 3. All ordinances and parts of ordinances in conflict with this Ordinance
are repealed to the extent of the conflict only.

Section 4. If any word, phrase, clause, sentence, paragraph, section or other
part of this Ordinance or the application thereof to any person or circumstance, shall
ever be held to be invalid or unconstitutional by any court of competent jurisdiction,
neither the remainder of this Ordinance, nor the application of such word, phrase,
clause, sentence, paragraph, section or other part of this Ordinance to any other
persons or circumstances, shall be affected thereby~
Section 5. This Ordinance and shall take effect immediately upon adoption and
sig nature~
