HomeMy WebLinkAboutOrd 1658 - fees & charges for activities, goods and service ORDINANCE NO. 1658 AN ORDINANCE ESTABLISHING AND REESTABLISHING FEES & CHARGES FOR ACTIVITIES, GOODS AND SERVICES PROVIDED BY THE CITY; CONTAINING A PROVISION TO AUTHORIZE THE CITY MANAGER TO ESTABLISH FEES AND CHARGES IN CERTAIN CIRCUMSTANCES; CONTAINING FINDINGS AND PROVISIONS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST UNIVERSITY PLACE: Section 1 ~ The City does hereby establish and reestablish the fees and charges Sl10wn in the attached Ex11ibit A, whiel1 is l1ereby il1corporated il1tO this ordinance by this reference for all purposes~ TIle fee schedule heretofore adopted is hereby amended in its entirety by this new schedule~ Section 2. Revised fees and charges apply from 811d after the effective date of tllis ordil1illlce and sI1all apply to individuals tra11sactions as follows: (1) completed applications for perlnits atld passes filed on or after the effective d.ate of this ordinance, and (2) billing periods beginning on or after the effective date of this ordinance, for mOl1tll1y or periodic services Section 3. In the case of any activity, goods or services provided by tIle City, includil1g review of the applications, permits, approvals, etc., for wIrieIl there is a measurable cost to tIle City, or for Wl1ich a fee or charge would traditionally be collected, the City Manager is authorized to establisll alld reestablisll fees and charges, but only in those circumstances in which a fee or a cllarge is not prescribed in Exhibit A~ 111 prescribing fees and charges, the City Mllilager shall first deterluine the eost to tIle City of providil1g the activity, goods or services, and the fees or charges sllall be as equivalent as practicable to tIle co st~ Section 4. All ordinmlces and parts of ordinances in conflict herewitll are 11ereby repealed to the extent of the conflict only. Sectiol1 5 ~ If any word, phrase, clause, sentence, paragraph, sectiol1, or other part of t11is ordinance or the applicatiol1 thereof to any perSOll or CirClllTIstance, shall ever be held to be invalid or ul1constitutional by any COllli of competentjurisdictiol1, neither tIle relnaillder oftllis ordil1ance, nor tIle applicatioll of suell word, pIllase, clause, sentence, paragrapll, sectiol1, or otller part of t11is ordinance to allY otller persol1s or circumstances, shall be affected tllereby. Section 6. The City COllncil officially finds, determil1es atld declares tllat a Sllfficient written notice of the date, 110ur, place and subject of each Ineetillg at ~./.... { Wllich this ordinance was discussed, considered or acted upon was given ill tIle manner required by the Texas Open Meetillgs Act, as amel1ded, 811d that each suell meeting has been open to tIle public as required by law at all times during such discussion, consideration a11d action~ The City Council ratifies, ap.proves and confirms such notices and tIle contents and posting thereof~ Section 7. This ordinance shall become effective on the tellth day following its publication, as provided in the City Charter. Section 8. The preparalion is done by a planner retained or elnployed by the City. Incidentals include legal notices, sw-veys, title and legal \vork, research, sib'llature requests, recording, copies, etc., as may be required and not provided by the applicant. DEPOSIT (non-refundable): A deposit anlowlt (due \vith the preliminary application) is estinlated by the City stafI: but the minimull1 deposit is a base fee of $400.00, plus $10.00 for each lot and reserve sho\vn on the plat or replat, plus $100 for those requiring ne\vspaper legal notice. (All prelinlinary costs TIlust be paid in full before plat or replat can be submitted for final approval). FINAL DEPOSIT (non-refundable): A deposit amount is due upon submi tta I for final approval. The lnininlulll deposit is abase fee of $150.00~ plus $10.00 for each lot and reserve ShO\V11 on plat or replat, plus $100.00 for each separate legal instrunlent needed (easements, etc.).
