CITY COUNCIL SPECIAL SESSION
MONDAY, FEBRUARY 17, 2003

The City Council convened in Special Session in the Municipal Building Council
Chambers (3800 University Blvd.) on February 17, 2003, with the following members
present: Mayor Lewis presiding, Council Members May, Farley, Griffin and Jackson.
The City Manager, City Secretary, City Attorney, Assistant City Manager/Public Works
Director and Parks and Recreation Director were also present.
The notice for this meeting was posted in accordance with the Texas Government Code,

Chapter 551, on the 14 day of February 2003 at 3:30 p.m.
Yards or ?setbacks? (calling joint public hearing).
Matters related to yards or ?setbacks? including Ordinance No. 1731.
Mayor Lewis read the caption of Ordinance No. 1731 as follows:
An ordinance calling a Joint Public Hearing on a proposal to amend the zoning ordinance
of the City of West University Place, Texas, regarding yards or ?setbacks? and related
regulations; prescribing procedures and notices; containing findings and other provisions
relating to the subject; and declaring an emergency
Copies of Ordinance No. 1731, in the form proposed for adoption, were available in the
Council Chambers.
City Attorney Jim Dougherty explained the proposed amendment. He stated that the
Zoning and Planning Commission approved and submitted a preliminary report which is
attached as Exhibit A to the back of the ordinance. The ZPC was actually considering a
package of three amendments, one being an amendment to the zoning ordinance, which is
the so-called 3/7 exception. The second amendment had to do with limitation of fences
along side lot lines particularly where buildings where close together. The third
amendment had to do with fire protection and sprinkler systems. The commission
ultimately determined that numbers 2 and 3 should be referred to the Building and
Standards Commission because they would not amend the zoning ordinance. They would
affect Chapter 6 and the International Building Code both of which are typically looked at
by the BSC.
Mr. Dougherty stated that the amendment that is being recommended by the ZPC would
set a limit of 8 feet separation between buildings even when using the 3/7 exception. The

Commission has recommended this to the City Council preliminarily and has suggested

that a joint public hearing be called for March 10.
A motion was made by Council Member Jackson, seconded by Council Member Farley,
to adopt Ordinance No. 1731 on the first and final reading.
Council Member Farley requested that items 2 and 3 relating to fences and sprinkler
systems be considered at the next meeting of the Building and Standards Commission.
He also stated that these items should be presented as a comprehensive report at the
public hearing.
The City Council agreed to include the three amendments for discussion during the public
hearing.
A vote was taken on the motion with the following result:

Friends of West University Place Parks Fund.
Matters related to the Friends of West University Place Parks Fund including expenditure
of $2,295 to the Texas A&M Landscape Architecture Program.
Joni Fichter, Chair of the Friends of West University Place Park Fund reported that the
Texas A&M Landscape Architecture programs has been contacted and asked to perform a
class project. This project would be to provide ?concept plans? for the possible
development of Rice Pocket Park. Approximately 20 students will travel to West U on
March 5, 2003. They are scheduled to tour the existing parks and review the pocket park
and its surrounding areas. The students will also attend a joint Friends/Parks Board
meeting. Each student will then submit a concept plan for the site at a later date.
A motion was made by Council Member Griffin, seconded by Council Member May, to
approve the expenditure of $2,295 to the Texas A&M Landscape Architecture Program.

With no further business to come before the City Council at this time, a motion was made
by Council Member Jackson, seconded by Council Member Farley, to adjourn. The
Council meeting adjourned at 5:35 p.m.
