CITY COUNCIL REGULAR SESSION
MONDAY, DECEMBER 6, 2004
MUNICIPAL BUILDING

6:00 P.M.
The City Council convened in Regular Session in the Municipal Building Council
Chambers (3800 University Blvd.) on December 6, 2004, with the following members
present: Mayor Ballanfant presiding, Council Members Segal, Fogler and Woods. The
City Secretary, Assistant City Manager/Public Works Director, City Attorney, Finance
Director, Police Chief and City Planner were also present. Council Member Farley was
absent.
The notice for this meeting was posted in accordance with the Texas Government Code,

Chapter 551, on the 3 day of December 2004 at 3:00 p.m.
Formal Session (in the Council Chambers)
Quiet Hours.
Matters related to quiet hours including Ordinance No. 1779.
Mayor Ballanfant read the caption of Ordinance No. 1779 as follows:
An ordinance relating to quiet hours; amending the Code of Ordinances of the City of
West University Place, Texas; and containing findings and provisions relating to the
subject.
Copies of Ordinance No. 1779, in the form proposed for adoption, were available in the
Council Chambers.
Assistant City Manager/Public Works Director Ron Wicker reported that an amendment
was added to ?carve out? certain youth sports events. The City Attorney is
recommending that the revised ordinance be considered for two readings.
A motion was made by Council Member Segal, seconded by Council Member Woods, to
adopt Ordinance No. 1779 on the first reading.
A vote was taken on the motion with the following result:
Voting Aye: Mayor Ballanfant, Council Members Segal, Fogler and
Woods
Voting Nay: None

Parks and Recreation Master Planning.
Matters related to Parks and Recreation Master Planning including all parks and
recreation areas in the City, conceptual plans, development and construction, outside
professional services, surveys, and appointment of a task force.
The City Council agreed that a Task Force would be appointed at the next meeting.
Interlocal Contract.
Matters relating to the proposed "master" interlocal cooperation contract between the
Cities of West University Place and Southside Place for building regulation service,
emergency medical service and street sweeping service, including alternative version(s)
with other combinations of such services.
Mr. Wicker reported that the City Attorney has provided two new versions of the
proposed interlocal agreement. The one with all three services is very similar to the

November 4 draft but makes it clear that West University will provide street sweeping
only once per month. The other version with only two services drops street sweeping
completely. Mr. Wicker stated that the City of Southside Place may engage an individual
company to provide street sweeping in their city.
City Staff is recommending that the Council adopt both versions of the Interlocal
Agreement. The version that Southside Place adopts will take effect and the other
version will be rejected.
A motion was made by Council Member Segal, seconded by Council Member Fogler, to
adopt the Master Interlocal Cooperation Contract between the City of West University
Place and the City of Southside Place in the alternative with the differences being that one
contract includes street sweeping and the other does not and the determination of which
contract is entered into will be up to Southside Place.
A vote was taken on the motion with the following result:

City Council minutes.
Matters related to the minutes of the Regular Session conducted on November 22, 2004.
A motion was made by Council Member Segal, seconded by Council Member Fogler, to
approve the minutes as amended.

Intergovernmental & Infrastructure Issues; Staff or Council Report.
Matters relating to intergovernmental relations and agreements including negotiations,
extra jurisdictional meetings, regional issues, City of Houston Water Rate Increase,
Metropolitan Transit Authority agreements, infrastructure projects, drainage, flooding,
Kirby Drive construction, Center Point Energy Entex, gas rates and coalition, Cason
Street entrance to the West University Recreation Center, City Center project, streetlights,
railroad quiet zones and task force, board and commission liaison reports and related
matters. This may include report(s) from staff and reports and directives to staff from
Council Members.
Mr. Wicker reported that the Staff was meeting with a company that sells and installs
wireless internet service for cities.
Mayor Ballanfant reported that Metro and HGAC are considering a circulator service
between the medical center and West University.
Mayor Ballanfant also reported that Judge Tom Taylor would be resigning as Presiding
Judge of West University Place effective December 31, 2004.
Council Member Segal reported that the ARF Task Force would be meeting on

Wednesday, December 8 Neighbors in the area have been invited to attend. He also
reported that the Rice Pocket Park Task Force has had several meetings and the Staff is
preparing the Statement of Qualifications to go out to a number of architects and
designers
Adjournment.
With no further business to come before the City Council at this time, a motion was made
by Council Member Fogler, seconded by Council Member Woods, to adjourn. The
Council meeting adjourned at 6:17 p.m.
