HomeMy WebLinkAbout112805R CC Min CITY COUNCIL SPECIAL AND REGULAR SESSION MONDAY, NOVEMBER 28, 2005 MUNICIPAL BUILDING 3800 UNIVERSITY BLVD. 5:30 P.M. The City Council convened in Regular and Special Session in the Municipal Building (3800 University Blvd.) on November 28, 2005, with the following members present: Mayor Ballanfant presiding, Council Members Cohen, Segal, Woods and Yehle. The City Manager, City Secretary, City Attorney, Assistant City Manager/Public Works Director, Finance Director, City Planner, Operations Superintendent, Public Works Coordinator and Assistant to the City Manager were also present. The notice for this meeting was posted in accordance with the Texas Government Code, nd Chapter 551, on the 22 day of November 2005 at 4:00 p.m. Special Session Sidewalks & Geographic Information System (GIS). Matters related to sidewalks and brief demonstration of City?s GIS. City Manager Michael Ross presented a map of the proposed sidewalks and estimated costs to install sidewalks in areas not previously planned. The City Council discussed the Sidewalk Master Plan and the addition of several locations for the installation of ramps and sidewalks. They also addressed safety issues and the placement of sidewalks in relation to the curbs. After a complete discussion of this item, Mayor Ballanfant called for a motion. A motion was made by Council Member Yehle, seconded by Council Member Cohen, to amend the Sidewalk Master Plan to include the following areas: Amherst on the North side from Wakeforest to Kirby; Carnegie on the South side from Buffalo Speedway to Wakeforest; Community on the East side from Law to Ruskin; Fairhaven on the East side between Ruskin and Villanova; Pittsburgh on the North side between Buffalo Speedway and Wakeforest; Plumb on the North side between Wakeforest and Charlotte; Rice on the South side between Wakeforest and Kirby; Wakeforest on the East side between Tangley and Bissonnet; Weslayan on the East side between Ruskin and Bissonnet; and West Point on the East side between Villanova and Bissonnet. A vote was taken on the motion with the following result: City Council Special and Regular Session, November 28, 2005 Voting Aye: Mayor Ballanfant, Council Members Cohen, Segal, Woods and Yehle Voting Nay: None Absent: None Council Member Yehle commented that still under review is Duke between Buffalo Speedway and Wakeforest, Edloe between Rice and University, Fairhaven south of Ruskin, Stella Link around the Ruskin/Bellaire triangle, Wakeforest between Tangley and Plumb and University and Cason. Infrastructure work in Priority Areas 9, 10, and 11B. Matters related to infrastructure work in Priority Areas 9, 10 and 11B including authorizing and approving an agreement with St. Paul Travelers, related contracts, agreements, surety bonds, completion, phasing, planning, etc. This item was not considered during this meeting. 3936 Marlowe Street; Weslayan Street. Matters related to 3936 Marlowe Street (Peden property) and Weslayan Street (from Bissonnet Street to Bellaire Boulevard), including easement or right-of-way matters, house under construction, legal defense, permits, administrative proceedings, pending or contemplated litigation or a settlement offer, and purchase, exchange, lease or value of real property and related issues. City Attorney Jim Dougherty reported that a minor motion was granted and the court has asked for re-argument of the summary judgement. Formal Session (in the Council Chambers) Citizen Comments. Mayor Ballanfant invited citizens who wished to address the City Council to come forward as their names were called. Ramsay Elder, 2821 Tangley, commented on articles he read about the use of the West University Recreation Center by rehabilitating athletes. He stated that if the City of West University can afford to provide a facility for the use of non-residents and professional basketball players it surely should be able to provide parks for the use by ordinary residents on the East side of the City. He requested that the Council make the purchase of property on the East side for park space a priority. 2 City Council Special and Regular Session, November 28, 2005 Jorge Jimeniz Marcos, 6636 Wakeforest, congratulated the Zoning and Planning Commission on their work with the 80% framed area rule. He asked a question about the proposed amendment and the affect it would have on his property taxes. Building Official and Administrative Official. Matters relating to the building official and the administrative official including Ordinance No. 1819. Mayor Ballanfant read the caption of Ordinance No. 1819 as follows: An ordinance related to the building official and the administrative official; amending the zoning ordinance of the City of West University Place, Texas; and containing findings and provisions relating to the subject. Copies of Ordinance No. 1819, in the form proposed for adoption, were available in the Council Chambers. City Planner Nes Tesnostated Ordinance 1819 will amend the zoning ordinance so that every reference to ?building official? would read ?administrative official?. The existing definition would be deleted and the following would be added: Administrative official. The person designated as such by the City Manager. The joint public hearing was held October 24,2005. The commission has issued a final . report to Council and is recommending that the amendment be adopted A motion was made by Council Member Segal, seconded by Council Member Cohen, to approve Ordinance No. 1819 on the second and final reading. A vote was taken on the motion with the following result: Voting Aye: Mayor Ballanfant, Council Members Cohen, Segal, Woods and Yehle Voting Nay: None Absent: None Framed Area. Matters related to framed area including Ordinance No. 1820. Copies of Ordinance No. 1820, in the form proposed for adoption, were available in the Council Chambers. 3 City Council Special and Regular Session, November 28, 2005 An ordinance related to framed area; amending the zoning ordinance of the City of West University Place, Texas; and containing findings and provisions relating to the subject Mayor Ballanfant read the caption of Ordinance No. 1820 as follows: Mrs. Tesno stated that this is the second reading of Ordinance No. 1820 regarding the framed area amendment and no changes have been made since the first reading was approved on November 11, 2005 except for the addition of the illustration, Schedule FA. ZPC has issued a final report to Council and is recommending that the proposed . amendment be adopted Council Member Woods requested a clarification on the illustration. He suggested that it show the imaginary plane going across the stairwell to the 7 foot height so that it is clear that any area over the stairwell or any kind of atrium area would also be included if it went over 7 feet above that imaginary plane. A motion was made by Council Member Yehle, seconded by Council Member Woods, to approve Ordinance No. 1820 on the second and final reading including Schedule FA as modified. A vote was taken on the motion with the following result: Voting Aye: Mayor Ballanfant, Council Members Cohen, Segal, Woods and Yehle Voting Nay: None Absent: None City Council minutes. Matters related to the minutes of the Regular and Special Session conducted on November 14, 2005. A motion was made by Council Member Woods, seconded by Council Member Segal, to approve the minutes conducted on November 14, 2005 as amended. A vote was taken on the motion with the following result: Voting Aye: Mayor Ballanfant, Council Members Segal, Woods and Yehle Voting Nay: None Absent: None Abstain: Council Member Cohen The motion passed 5-0. 4 City Council Special and Regular Session, November 28, 2005 Intergovernmental & Infrastructure Issues; Staff or Council Report. Matters relating to intergovernmental relations and agreements including negotiations, extra jurisdictional meetings, regional issues, Interlocal Agreements with the City of Southside Place, Metropolitan Transit Authority agreements, infrastructure projects, drainage, flooding, Kirby Drive construction, Center Point Energy Entex, gas rates and coalition, City owned properties, potential purchase of property, City Center project, streetlights, railroad quiet zones and task force, board and commission liaison reports and related matters. This may include report(s) from staff and reports and directives to staff from Council Members. City Manager Michael Ross reported that bids for the Sidewalk Project 4 would be opened on December 8, 2005. th Mr. Ross requested that the Council Meeting scheduled for December 5 begin at 5:00 p.m. in order to allow for enough time for a municipal wireless and broadband presentation. A motion was made by Council Member Cohen, seconded by Council Member Yehle, to begin the Council meeting scheduled for December 5, 2005 at 5:00 p.m. A vote was taken on the motion with the following result: Voting Aye: Mayor Ballanfant, Council Members Cohen, Segal, Woods and Yehle Voting Nay: None Absent: None Council Member Cohen asked about the Police Station renovation. Mr. Ross stated that the Staff would engage someone to do the conceptual planning of the building and begin discussions in the 2006 Budget year. Council Member Yehle inquired about the delay of the quiet zone. Mr. Ross stated that the Federal Railroad Administration had some comments and slight modifications on the City of Houston?s submittals of the detailed construction drawings of the improvements. These comments created a new 60-day comment period among all of the entities. The new implementation date is now in March instead of January. Adjournment.
