HomeMy WebLinkAbout050205S CC Min CITY COUNCIL SPECIAL SESSION MONDAY, MAY 2, 2005 MUNICIPAL BUILDING 3800 UNIVERSITY BLVD. 5:30 P.M. The City Council convened in Special Session in the Bill Watson Conference Room (3800 University Blvd.) on May 2, 2005, with the following members present: Mayor Ballanfant presiding, Council Members Segal, Farley and Fogler. The City Manager, City Secretary, City Attorney, Assistant City Manager/Public Works Director, City Planner and Building Official were also present. Council Member Woods was absent. The notice for this meeting was posted in accordance with the Texas Government Code, th Chapter 551, on the 29 day of April 2005 at 5:00 p.m. Foundations. Matters related to foundations including Ordinance No. 1791. Mayor Ballanfant read the caption of Ordinance No. 1791 as follows: An ordinance relating to foundations; amending the code of ordinances of the City of West University Place, Texas; containing findings and provisions relating to the subject; and declaring an emergency. Copies of Ordinance No. 1791, in the form proposed for adoption, were available in the Council Chambers. Mayor Ballanfant inquired as to why the second reading of Ordinance No. 1791 was on an emergency basis. City Attorney Jim Dougherty stated that in order to adopt the Ordinance in a Special Session it needed to be on an emergency basis. Mayor Ballanfant called for a motion on the emergency clause. A motion was made by Council Member Farley, seconded by Council Member Fogler, to consider Ordinance No. 1791 on an emergency basis. A vote was taken on the motion with the following result: Voting Aye: Council Members Segal, Farley and Fogler Voting Nay: Mayor Ballanfant Absent: Council Member Woods City Council Special Session, May 2, 2005 The motion passed 3-1. Bryant Slimp, Chair of the Building and Standards Commission, presented a report, which included responses to the issues and concerns of Mr. Talianchich during the Council Meeting on August 25, 2005. Mayor Ballanfant asked numerous questions regarding the proposed ordinance. A motion was made by Council Member Farley, seconded by Council Member Fogler, to adopt Ordinance No. 1791 on the second and final reading. A vote was taken on the motion with the following result: Voting Aye: Mayor Ballanfant, Council Members Segal, Farley and Fogler Voting Nay: None Absent: Council Member Woods 3936 Marlowe Street. Matters related to 3936 Marlowe Street (Peden property), including easement or right-of- way questions, Weslayan Streeet, construction project, legal defense, permits, administrative proceedings, pending or contemplated litigation or a settlement offer and related issues. At this point in the meeting, the Mayor publicly announced that a closed, executive session would be held and identified the section of the Open Meetings Law under which the meeting would be held. Closed Executive Session to be held under Sections 551.071 and 551.072, Texas Government Code After the announcement, the City Council conducted a closed, executive session beginning at 6:00 p.m. Present at the meeting were Mayor Ballanfant, Council Members Segal, Farley and Fogler. Staff members present were the City Manager, City Secretary, City Attorney, Assistant City Manager/Public Works Director, City Planner and Building Official. After the closed, executive session, the Mayor announced, in open session, that the City Council had concluded its closed, executive session at 6:55 p.m. A motion was made by Mayor Ballanfant, seconded by Council Member Farley, to authorize the City Manager and City Attorney along with Council Member Segal and in case of his inability to perform then Council Member Fogler, to interview outside Counsel to represent the City of West University Place. 2 City Council Special Session, May 2, 2005 A vote was taken on the motion with the following result: Voting Aye: Mayor Ballanfant, Council Members Segal, Farley and Fogler Voting Nay: None Absent: Council Member Woods Adjournment. With no further business to come before the City Council at this time, a motion was made by Council Member Fogler, seconded by Council Member Farley, to adjourn.
