HomeMy WebLinkAbout072307R CC Min CITY COUNCIL SPECIAL AND REGULAR SESSION MONDAY, JULY 23, 2007 MUNICIP AL BUILDING 3800 UNIVERSITY BLVD. 6:15 P.M. The City Council convened in Special and Regular Session in the Municipal Building (3800 University Blvd.) on July 23,2007, with the following members present: Mayor Pro Tern Fry presiding, Council Members Cohen, Guffey and Talianchich. The City Manager, City Secretary, City Attorney and Assistant City Manager/Public Works Director were also present. Mayor Kelly was absent. The notice for this meeting was posted in accordance with the Texas Government Code, Chapter 551, on the 20th day of July 2007 at 11 :00 a.m. Special Session Water rates. Matters related to water rates including a proposed increase from the City of Houston, process for appealing the rates and authorization to appeal. At this point in the meeting, the Mayor publicly announced that a closed, executive session would be held and identified the section of the Open Meetings Law under which the meeting would be held. Closed Executive Session to be held under Section 551. 071 (consultation with attorney), Texas Government Code. The City Council agreed to allow City Manager Michael Ross, City Secretary Kaylynn Holloway, City Attorney Alan Petrov and Assistant City Manager/Public Works Director Chris Peifer to attend the Executive Session because their presence is necessary for the Council's consideration of the issues. After the announcement, the City Council conducted a closed, executive session beginning at 6:15 p.m. After the closed, executive session, the Mayor announced, in open session, that the City Council had concluded its closed, executive session at 6:28 p.m. The City Council adjourned the Special Session at 6:30 p.m. to convene in Regular Session. City Council Regular and Special Session, July 23, 2007 Formal Session Citizen Comments There were not any residents who wish to speak at this time. Emer2encv Mana2ement Plan. Matters related to an Emergency Operations Plan including Ordinance No.1850. Mayor Pro Tern Fry read the caption of Ordinance No. 1850 as follows: An ordinance of the City of West University Place, Texas, establishing a program of comprehensive emergency management which includes the mitigation, preparedness response and recovery phases of civil, preparedness; acknowledging the office of emergency management director; authorizing the appointment of an emergency management coordinator; and providing the duties and responsibilities of those offices; identifying an operational organization; granting necessary powers to cope with all phases of emergency management which threaten life and property in the City of West University Place, Texas; authorizing cooperation and mutual aide agreements for relief work between this and other cities or counties and for related purposes; prohibiting unauthorized warning and all-clear signals and making violations a misdemeanor punishable by fine not to exceed $500.00; finding compliance with the open meetings law; providing a severability clause; and providing an effective date hereof Copies of Ordinance No. 1850, in the form proposed for adoption, were available in the Council Chambers. Fire Chief Steve Ralls reported that the 2007 Emergency Management Plan outlines the City's approach to emergency operations, and is applicable to both Harris County and the City of West University Place. It provides general guidance for emergency management activities and an overview of the City's methods in mitigation, preparedness, response, and recovery. The plan describes the emergency response organization and assigns responsibilities for various emergency tasks. This plan is intended to provide a framework for more specific functional annexes that describe in greater detail who does what, when, and how. This plan applies to all West University Place officials, departments, and agencies. The primary audience for this document includes the Mayor, City Council, City Staff, local volunteer organizations that support emergency operations, and others who may participate in the efforts. A motion was made by Council Member Cohen, seconded by Council Member Talianchich, to approve Ordinance 1850 on the first reading. 2 City Council Regular and Special Session, July 23, 2007 A vote was taken on the motion with the following result: Voting Aye: Voting Nay: Absent: Mayor Pro Tern Fry, Cohen, Guffey and Talianchich None Mayor Kelly The motion passed 4-0. The ordinance will be presented to Council for the second and final reading along with the adoption of the required West U/ Harris County joint resolution at the next Council meeting. City Council minutes. Matters related to the minutes of the Regular and Special Session conducted on July 9, 2007. A motion was made by Council Member Cohen, seconded by Council Member Talianchich, to approve the minutes of July 9, 2007 as presented. A vote was taken on the motion with the following result: Voting Aye: Mayor Pro Tern Fry, Council Members Cohen, Guffey and Talianchich None Mayor Kelly Voting Nay: Absent: The motion passed 4-0. Council Reports There were not any reports given at this time. City Mana2er Report The City Manager reported that the Union Pacific Railroad was still making an effort to clean up the area on Community where the derailment occurred but the process was slow because of the raIn.
