Applicant's Request
The applicant in Docket #2022-0006- 6218 Auden St., requests that the Board approve a special
exception as allowed by Appendix A—Table 7-5a, Note 7, to allow a parking area to be constructed in
another location and with a different design than prescribed by the Zoning Ordinance.
Background Information
The legal description of the site is College View Third Addition Block 15. The site includes lots 10, 11,
12, 13, 14, & 15 according to Vol 572, pg. 33 of the HCDR. These parking lots are primarily used to
service the parking needs of the place of worship located at 6218 Auden. The applicant desires to
renovate the existing parking lots (located at 3408 Milton St) to create one cohesive parking lot with
additional spaces provided. The scope of the project includes additional parking spaces (8 new spaces), a
reduction in curb cuts, new parking lot lighting, a new wooden 8' rear fence, and the installation of
additional trees and shrubbery. The place or worship currently utilizes three adjacent, but unconnected
parking lots to satisfy their parking needs. The proposed parking lot should ease traffic congestion and
increase safety for the place of worship's congregation.
Updates
The applicant has revised their plans in response to comments received from the ZBA.
Parking:
The applicant has modified their parking plan to remove the proposed parallel parking spaces.
However,plans still show a portion of the site adjacent to Milton St as area that could potentially be
used for street parking and may need to be modified. A potential solution would be to continue the
proposed landscaping strip across the full distance of the lot between curb cuts.
Landscaping:
Applicant has met with the City Arborist and has submitted an updated landscaping plan showing
additional trees and shrubbery for the proposed parking area.

Lighting:
Applicant has submitted a photometric plan showing light levels along all property lines. The north
side of the lot is the most important area to be considered, as the north side is directly adjacent to a
residential area. Photometric plan indicates a peak light level of 0.7 fc(foot-candles) on the north
side of the lot.
Fencing:
Applicant has confirmed that they plan to install a new 8' wooden fence along the north side of the
lot.
Special Exception Request
Appendix A, Article 7, Table 7-5a states as a general rule that every building site, vehicular area and
related structure must conform to the applicable regulations shown,by district, in the corresponding table
per defined item.
Table 7-5a, Note 7 of the Zoning Ordinance authorizes the ZBA to grant this special exception for
parking area, garage or driveway(or other maneuvering area) in another location with a different design
than prescribed by this ordinance,if it finds that:
(i) The other location design will not unreasonably interfere with available light and air and will not
significantly alter access for fire-fighting and similar needs
(ii) The other location or design will prevent destruction of a qualified tree,
(iii) In the case of the remodeling of a principal building, the location requested is the same location as
an existing parking area,garage or driveway;or
(iv) The location or design requested is necessary for safety considerations.
The ZBA may not issue or modify a special exception unless all the following circumstances are present:
1. The request is in harmony with the general purpose and intent of the Zoning Ordinance
2. The request will not cause any significant increase in on-street parking or traffic,traffic congestion or
an unreasonable burden upon public utilities or services
3. The ZBA has made any additional findings and determinations required by a specific provision of this
section
4. The special exception has been reduced to writing and includes any conditions prescribed by the ZBA
or required by this section for the special exemption in question.
The Board may approve,deny or approve with conditions a special exception.

Recommended Conditions
1. All lighting shall be shielded so that substantially all emitted light falls within the property lines of the

The three unconnected existing parking lots have a total of 77 spaces, including three accessible spaces.
The majority of the spaces do are in a lot whose parking aisles are far narrower than required by city
standards.The goal of the church is to combine these inefficient lots into a single lot with efficient
circulation and code compliant spacing.

The three parking modules on the left are 50'wide.With the two-way traffic pattern and 60 degree
angled parking, the city standards(and accepted good practice)call for a 60'width.The center lot is
dead end with no turn-around.To design the lot to come as close as possible to meeting city standards,
the lot would have 45-degree angled parking and one-way traffic.This design would yield 71 spaces,
but would still not meet city requirements,and leave dis-connected lots with poor flow.

The proposed lot will be far more efficient with far greater ease of access and egress. It will provide 89
spaces, including four accessible spaces,16 more than the lot that comes closest to meeting city
guidelines.These additional spaces will more than meet the city's parking requirements for the planned
4,215 S.F.new Welcome Center.
The scope of work will include parking lot lighting. Lighting will be 3500 degree LED fixtures on three
poles located in the triangular areas between the angled and head-in parking.We will review the
photometric study with the city to confirm there is no light spill onto the existing residences.We will
work closely with the city as we develop the parking lot in more detail, including working with the city
arborist to meet the city's landscape requirement.

NOTICE OF ZONING BOARD OF ADJUSTMENT HEARING
The Zoning Board of Adjustment ("ZBA") of the City of West University Place, Texas ("City") will hold a
public hearing in the Municipal Building, 3800 University Boulevard, City of West University Place, Texas
77005, during a meeting set to begin at 6:30 p.m. on July 28, 2022. The hearing may be recessed and
continued to a ZBA meeting set to begin at 6:30 p.m. on August 25, 2022. The purpose of the hearing is to
provide an opportunity for all persons to be heard in relation to the following matter:

Additional Details: Applicant is requesting a Special Exception to Appendix A, Article
7, Section 7-101, Table 7-5a, Note 7, to allow a parking area to be
constructed in another location and with a different design than
prescribed by the Zoning Ordinance. Applicant wishes to remodel
a prior non-conforming parking lot for an existing place or
worship.
Applicable regulations include the City's Zoning Ordinance, Code of Ordinances, Chapter 211 of the Texas
Local Government Code and the rules of the ZBA. The application is available on the city's website at
www.westutx.gov. Additional details on such matters, as well as the applicable regulations are also available
for public inspection in the Public Works Center, 3826 Amherst, West University Place, 77005. Any
person interested in such matters should attend the hearing.
