MEETING MINUTES
June 9, 2022
MEMBERS PRESENT: John Cutrer, Richard Wilson, Bob Powell, Matthew Fisher,
Sam Mazzu, Myrenda Takashima and John Howard
STAFF PRESENT: Legal Counsel Lawrence Smith, Public Works Director
Gerardo Barrera, Administrative Coordinator Josie Hayes
and Zoning Officials Evan Duvall and Joe Newton
GUEST: Sabina Walia
1. Notices, Rules, Etc. John Cutrer; Presiding Officer, called the meeting to order at 6:18
p.m. John Cutrer asked staff to confirm that appropriate notices were given. Josie Hayes
stated notices were posted per state and local laws. John Cutrer asked commission
members and staff to introduce themselves.
2. Public Comments There were no public comments.
3. 3/7 Exemption. Joe Newton briefly discussed the additional information that was
requested from the ZPC from the previous meeting. There was general discussion
regarding the required distance the neighbor's house has to be in order for someone to
take the 3/7 Exemption. There was general discussion if garages should be located at the
rear of the property if the exemption is taken. Richard Wilson made a motion to abolish
the 3/7 Exemption. There was no second. Motion failed. The ZPC asked staff to modify
the existing ordinance that states the garage would be required to be placed at the rear
yard; if not; a special exception or variance would be required if certain criteria was not
met and bring back to the next meeting.
4. Driveway width requirement. Evan Duvall stated the survey of Mercer was done and
there were only two prior nonconforming driveways. There was brief discussion
regarding the driveway width requirement. Richard Wilson made a motion to indefinitely
table the item. Second by Bob Powell. AYES: John Cutrer, Richard Wilson, Bob Powell,

ABSTAIN: None. Motion carried.
5. Curb Cuts/Corner Lots. Joe Newton briefly described the additional information that
was requested from the previous meeting. The different kind of configurations that
currently exist in the city and the proposed changes were discussed. After general
discussion, the ZPC asked staff to get with the city attorney to modify the language and
bring back to the next meeting.
6. Old Stock Housing. Joe Newton briefly described the proposed changes from the last
meeting. There was discussion regarding the following items: why the 1980 date was
used for the definition for Old Stock Housing and if the date should be changed; reduced
fees for going before the ZBA and if reduced taxes should or could be allowed for Old
Stock Housing. The ZPC asked staff to research the 1980 date and bring back to the next
meeting.
7. Sports Courts. Evan Duvall and Joe Newton briefly explained the additional information
that ZPC asked for at the previous meeting. There was general discussion regarding the
additional information provided. The additional definition of sports courts and batting
cages. There was some discussion as to where the 20'x30' requirement came from. The
ZPC asked staff to modify the proposed language and bring back to the next meeting.
8. SF District Consolidation. Joe Newton gave a brief overview of the additional
information that ZPC requested from the previous meeting. He stated there was one
minor difference in SF Districts 1, 2 and 3 regarding rotated corner lots. There was
discussion of it could be combined in a meaningful way that would make it easier to read.
There was brief discussion regarding subdividing lots and what the requirements are.
Evan Duvall asked that the item be tabled until the next meeting so the City Attorney,
Scott Bounds can explain it better.
9. Minutes. The commission reviewed the minutes of the meeting held on May 12, 2022.
Sam Mazzu made a motion to approve the meeting minutes. Second by Bob Powell.
AYES: John Cutrer, Richard Wilson, Bob Powell, Matthew Fisher, Sam Mazzu,
Myrenda Takashima and John Howard. NOES: None. ABSTAIN: None. Motion
carried.
