HomeMy WebLinkAbout01062022 BSC Minutes West University Place Public Works Department Building & Standards Commission Located in the Council Chambers, 3 800 University Blvd, West University Place, Texas 77005 Meeting Minutes January 6,2022 MEMBERS PRESENT: Bruce Beneke, Muddy McDaniel, James Craig, Anthony Beebe, Eddie Mathews, David Flame, Jonathon Hance, Charles Marshall MEMBERS ABSENT: Gerry Spedal STAFF PRESENT: Director of Public Works Gerardo Barrera, Legal Counsel Scott Bounds, Chief Building Official Alfonso Acosta, Permit Technician Mike Morris GUESTS PRESENT: David Cole, Steve Brown, Ed Heathcott, Dick Yehle, Mary Yehle, Alita Drews. [Call to Order] Bruce Beneke called the meeting to order at 6:00p.m. 1. Notices, Rules, Etc. Bruce Beneke welcomed BSC members and staff to the meeting. Mike Morris swore-in Dick Yehle as witness for testimony. 2. Meeting Minutes. Eddie Mathews made a Motion to approve meeting minutes from November 4, 2021 with minor corrections by David Flame, James Craig seconded. AYES Bruce Beneke, Muddy McDaniel, James Craig, Anthony Beebe, Eddie Mathews NOES: None. ABSTAIN: None. Eddie Mathews made a motion to suspend Building Standards meeting and go to the public hearing on Dick Yehle appeal. Anthony Beebe seconded. AYES Bruce Beneke, Muddy McDaniel, James Craig, Anthony Beebe, Eddie Mathews NOES: None. ABSTAIN: None. 3. Appeal of a decision regarding drainage plans. Chief Building Official Alfonso Acosta read off requirement of a drainage plan as stated per Section 18, 56. Alfonso Acosta went on to explain the review process and items that have to be taken into consideration for green space proposals, Alfonso Acosta went on to present a slide show of the site in question and examples of demolition process. 3826 Amherst St. www.westutx.gov West University Place, TX 77005 713-662-5830 City of West University Place Public Works Department Dick Yehle explained various reasons that the property in question presents no drainage issue to surrounding properties and he currently lives in one of the surrounding properties there for the property in question should be Deemed low impact per Section 18, 56. Alita Drew gave statements in regards to area flooding. BSC members discuss the issues of drainage impact and asked questions to Dick Yehle to affirm the intentions for demolition to green space only. BSC members go on to ask Alfonso Acosta if he has had issues in the past regarding drainage issues with previous demolition to green space projects. Alfonso Acosta explain that he had spoken with the previous Building Official and we on to explain that the City of West University place has always required and approved drainage plan prior to demolition. BSC members went on to discuss various possible drainage issues through to the City of West University place and the reasons for requiring site drainage plans. Dick Yehle went on to explain reason for his appeal. BSC members discussed definitions and how to conclude the appeal for a low impact assessment. BSC member discussed the possibility of approving the appeal with conditions that the lot will not hold water and is deemed low impact. Scott Bounds confirmed that BSC had the authority to grant a waiver of Chief Building Officer's decision. James Craig made a motion to affirm the ruling by the Building Official Alfonso Acosta. Anthony Beebe seconded. Bruce Beneke recused himself from voting due to conflict of interest. AYES: James Craig, Anthony Beebe. NOES: Eddie Mathews, Muddy McDaniel, Charles Marshall. ABSTAIN: None. Recused: Bruce Beneke. Eddie Matthews made a motion to grant the appeal request on conditions that the lot maintain the definition of low impact in regards to fill and positive drainage. Muddy McDaniel seconded AYES: Muddy McDaniel, Anthony Beebe, James Craig, Eddie Mathews, Charles Marshall NOES: None. ABSTAIN: None. Recused: Bruce Beneke. James Craig made a motion to close the public hearing and return to meeting agenda items. Eddie Matthews seconded. AYES: Bruce Beneke, Muddy McDaniel, James Craig, Anthony Beebe, Eddie Mathews NOES: None. ABSTAIN:None. 4. Selection of Vice Chair. Eddie Matthews made a motion to nominate himself. Muddy McDaniels seconded. AYES: Bruce Beneke, Muddy McDaniel, James Craig, Anthony Beebe, Eddie Mathews NOES: None. ABSTAIN: None. David Cole made statements regarding State and Local requirements regarding regulation of building materials and various other items in regard to code violations.
